"OUR HOUSE IS A VERY NICE HOUSE"

Painesville special council meeting this evening to address the drainage problems that Heisley Park residents have been attempting the the city to find a solution to water issues was held tonight.
Morrell Properties was in attendance, along with Ryan Homes and of course some of the residents who have been having water issues.
Ryan Homes representatives wouldn't even say hello. I guess they were lawyered up?
Mr. Mortell voiced his concerned and was looking for a workable solution for everyone? He brought along a geologist from Mannik&Smith he
explained about glaciers forming and ridges, along with something called "Painesville Soil"?
Council people asked question to him along with the city engineer to find out why sump pumps were burning out due to constant use, storm sewers,french drains ect.
In the end the city will set up independent meetings with the city, Mortell, Ryan Homes and the residents to find a solution to these water problems. One resident stated "I would never have bought a home in Heisley Park if I knew this condition existed." "Why wasn't I informed by Ryan Homes or the city about these issued when I asked before I purchased my home?"
How is this going to end? The residents will hire a law firm, and he file a class action lawsuit against Ryan Homes, Mortell, and the city of Painesville. I hope I'm wrong but I see now, no way this can be settled outside the courts. The expense is to great for everyone, and the residents I sensed were losing Patience.
Note; A quality sump pump can cost $500.00, how many could you afford to purchase?

Simple you don't build or sell a house in a swamp especially with a basement. I guess they will build you anything, anywhere if your willing to pay. The people should have hired a lawer first, then gone to the meeting. New to Painesville I guess?

Was the newspaper there? If they were they have sold the last house in this development. Just maybe they should have called in the geologists in before they started to build ?

Maybe the catails should of been a warning sign.... ??? or that low flat land by a tall RxR tracks... Ignorant people with money... you will not have catails at the hospital site... high and dry.. and cheaper... wonder if these people will want Pvll. to buy them toilet paper and wipe their... too?

The homeowners Insurance Co. should be in on the lawsuit, that is if the homeowners had water/sewer backup on there insurance, anyone with a sump pump should have it.

Northeastern Ohio is part of the Lacustraine Plain has anyone of these developers looked into the enviromental problems this development might cause?

Little rough on the homeowners aren't you? Maybe they were assured there were no water issues when they purchased their homes? People should expect honesty when they make a purchase of this size and most never lived in the area. I can hardly wait until Lakeview Bluffs starts building homes.
Will someone explain this Lacustraine Plain?

This is what I have come to expect from Ryan Homes..cheap materials and cheap quality homess that were sold at an inflated price. The Heisley Park area is built on what used to be an underground gas storage facility and dumping grounds for the old Diamond. I remember driving through the property when they first started excavating and noticing how bad the area smelled, the same smell like the old soup pond in the township.

I read the newspaper article and noted how the one idiot claimed "well its normal for your sump pump to turn on every five minutes"..oh really. I live in a new housing development (surely not Ryan Homes) and well..hmm..the only time my sump pump has kicked kicks on is when its raining so hard I expect to see Noah's Ark floating by.

It's unfortunate the city hooked up with Ryan Homes to be sole builder in the city, as there are number of other quality builders that I would have looked at. Take a visit down to Lake Erie Shores one day.. But from having spoken with a number of builders in my development, they all say the same thing.."Painesville is nothing but a pain in the a** to deal with it". Shocking..

A Lacustraine plain is a plain that originally formed in a lacustrine environment, that is, as the bed of a lake, but from which the water has disappeared, by natural drainage, evaporation or other geophysical processes. The soil left behind may constitute fertile productive farm land, due to the previous accumulation of lacustrine sediments. In other cases it may be a wetland or a desert. There is much to learn about this geological feature that we here south of Lake Erie experience.

I only hope all of you realize how much your complaining has cost me today? I live in Heisley Park and only because of three or four "discontents" My property and investment will be hard to recoup.

The city manager and council president knows theres no real problem here. How are you going to lower the water table in the whole area?

Anyone who would buy a house there should have water in the basement, they must have had water for brains, just pull in the drive off of Jackson St. stop and look down the hill to where the houses are, do you thing it might be a little low down there ?

A simple answer to what was accomplished at that special council meeting? ZERO ZILCH I didn't hear anything I hadn't heard before.
We will do more studies on the drainage issues? more meetings, ect. ect. ect.
Nothing ever gets done. Maybe this will be resolved after the city is finished at Millstone, they have been only waiting there forthree years,right?

Starting to wonder if Painesville is a location, or a state of mind?

Back in the Day, a most wise elected county official made a comment about building homes: "You just don't build homes in an area that has always been a part of the Mentor Marsh." Water is water and no matter how much soil you transplant, how many drain ponds you build, it will always be traveling water on its own course! This area of Heisley Park has been what it is for hundreds and hundreds of years. Property of the Painesville Township Trustees that have always stated this area of land cannot be developed into any housing or business developments. It is a natural area and should be as it is. Did anyone listen or pay attention? NO. Meetings - State/Federal Engineers and comments by many educated individuals in this county - Did anyone Listen? No. Yet, everyone allowed this area and many others to be annexed for such wonderful housing developments that were voted on by Council by the Lead of a person that absolutely has no knowledge of any current nor future parameters of how Community Development should transpire. Water problems at this early point in the development; these homes will finally settle into the ground areas and these problems will become more than anyone can possibly handle. Build a Street and a Bridge to No Where in an area that is so saturated with water - we think not.We are a Railroad Family since 1976. We repair this water-logged area regularly. If a Home is unstable for the water, how much stability will be provided for the C.M.'S idealistic dreams for her Road and Bridge? Sink, sink, repair over and over again??
When Argonne Arms and Shamrock was built and settled into the ground, we the people on N. State Street have been paying the price for many many and many years.
Hogwash to Mortell/Assoc. for your statement that you were not aware of the water table at Heisley Park. You attended some of the meetings but never questioned any reports. Why? This annexed land by Rita McMahon and former soldiers of hers (do the research) was given to you on an "under-the-table deal" at a nickel-dime price. It is too bad that the major player in all of this is resting in his grave and I hope not in Peace.
Zoning Commission/Board of Zoning Appeals Representatives are hand-picked to satisfy the whims/plans of R.M. If you R.M. and your rubber-stamp council would realize that there are many of us that have more knowledge and would prevent the happenings in your "Crown Victoria" developments: maybe, just maybe you could do the job right the first time instead of having to do it over and over again: then make excuses and in minutes of meetings just change your previous untruth statements. There is an at-large council memember that accused a
Ward council member of
mal-feasance. Do any of you know the definitions of mis/mal/non Feasance? Oh I am sure that the Hurley Gurley Rep, will enlighten all of you and find some type of "off-the-wall" to grant you amnesty. The O.R.C code is very specific towards your actions: and, the County Prosecutor is your Watch-Dog as this is His/Her Job.

Painesville is the only community in all of Lake County that passes ordinances and never ever pursues the infractions. Gee, I wonder why??
Quit playing your kindergarten games and try to grow-up. Quit being a rubber-stamp for the C.M.
When you take the Oath of Office, as I have, do this as the Individual you were when you ran for Office. Do not take the Oath and then be coerced by those who have sat way too long and only are a Czar of her ideas - those that choose to take the easy route and never think but let her think for and demand of you. These type of people are not wanted nor needed and will be recalled as they are not an asset: just another puppet liability in the City of Painesville.

My sump pump usually only kicks on after the temperatures rise after a huge snowstorm.

I do believe we have to lay some blame on the government officials that let the homes be built there, but people also need to use common sense when purchasing a house. Anyone who looked down there could tell it was a low lying area, and to top it off, I've heard for years that there were underground gas wells there that could eventually be a problem. Ryan Homes is also a horrible builder. When we were looking at homes a few years ago, it just appeared that anything they built was built on the cheap.

painesville soil is very unique. just take off your shoes and rub your feet in it. instantly you will complain about everything and be a malcontent. you will let your house deteriorate, lose your job, your basement will flood, and your lights will go out.

then you will have the true understanding of a lacustrine environment.

I was told once that the Mentor Marsh and all that wetlands were created by the Army around the Civil War by changing the natural direction of Grand River. It use to exit by Mentor Lagoons but they made a direct cut cut to the Lake in Fairport Harbor. I have no idea if this is true does anyone know?

Painesville soil is whats left after all the carpetbaggers run home to your homes in the township. This city's only reason for existence is to provide you with a comfortable job. You and the others take full advantage of it to. Please wipe your feet before you step into my city and complain. Most of you are the reasons for the complaints.

Charterlady, come on, just post as Charterlady, we can tell it's you. Do you have any proof of what you stated, about the "under-the-table deal"? That would be interesting to get a look at.

What Oath of Office are you talking about? We keep saying that you really ought to be officially involved in the government of the City - if you're not, you should be; if you are, then what are you doing about these problems?

You obviously have a lot of inside information that most of us don't have access to. And a way with words that few people can match. You really do need to run for some kind of office!

Term. the reason nothing moves forward is all the high priced help at city hall hasn't a clue how to solve this. I remember Joe Hada said alot of people didn't believe people would buy at Heisley Park? I wonder how many wish they hadn't?

I have been curious about what the solution of this problem will end up being. If everyone was honest they would remember what Mr. Mortell stated at the meeting "It is impossible to lower Lake Countys water table."
I thought this has probably happened in other locations around the country? I was told about a town in New,York called Amherst. They faced almost the same problem . I will try to get records to see how this was settled and ask other concerned residents to help me do the same. In Amherst the homes started to sink? and I believe all construction was halted. The truth of the matter is I have found so far it shows poor judgement to build on wetlands period.

I have a sump pump in my basement it rarily goes on only during heavey rain. I was informed by the city to pump the water from the sump pump 14 feet from my foundation. If they are also doing this a Heisley Park it will go on over and over again. Maybe there sump pumps should be connected to the storm sewer? So the ground water can drain out of the development.

I would like to know, is it possible years ago the water table in this area wasn't this high during original land investigation and then after the "Big Flood" how much did it rise?

That was after all a 1,000 year rain it was so huge, it probably added quite a bit to the water table that will take many, many years to lower again.

7:27 Its was a heavy rain, but that was a swamp,marsh, wetlands whatever for thousands of years and only fools led by bigger fools would even think about building a home in Heisley Park let alone ones with basements. The residents should sue everyone involved.
