TUESDAY'S NEWS-HERALD PAGE 2

A story about an arrest made in Painesville allegedly about a hand to hand drug deal.Leopoldo Ramiriez-Rodriguez 23 of Jefferson St. is the accused.
Leopoldo has an outstanding warrent in Sarasota County Florida for forgeing, stolen Drivers Licenses which I believe he must have skipped out on.
My question is why young Leo chose Painesville, Ohio as his destination? Family, friends, a job, or a place that isn't to concerned with who you are? Maybe he heard about Painesville on a Fox T.V. program? I have to believe it wasn't the climate that made him come here to face allegations of selling methadone and or morphine. Why Painesville? and please don't tell me it the weather.

Do you really think we was at home catching up on current events and worldy issues and paid for cable just to watch Fox, the most right-wing channel on tv, for a place to go? Please this is a bit of a stretch. I doubt this guy watches the news at all. I have no idea why he came to Painesville. This story should be a testament to our police. This guy was a criminal running all over the country and when he came to our town he got busted. He was not locked up an prosecuted until he got here. That should dissaude others criminals from choosing Painesville as their destination.

He heard the song in which the city of Painesville is touted as welcoming the illegals. If our system really worked we would have picked up all the illegals, not just one. And just wait and see if Cicconetti lets him loose.

Lets clear this up, the Judge does not verify anyones legal status, not his job. It is left to ICE and so is the prosecution of that person for being here illegally. The judge just takes care of the local stuff as he has no jurisdiction to do otherwise. So, to blame a judge for not taking care of an illegal person is like blaming the hair salon for not selling tires. JT

The prosecutor is the one that has to bring charges whether for a crime or citizenship. A judge can only judge what comes before him. He can't make up charges for a defendant.

Wrong, being illegal is not punishable by local or even State courts. They have no jurisdiction. You are right in one sense, the prosecutor does do charges, but they can only charge local and State charges. Being illegal is Federal and needs to be addressed by the Federal government. Call the Cleveland ICE office for yourself and ask, they will be glad to answer you. JT

jt. I'll take you at your word but robbing a bank is breaking a Federal Law. Do local authorities wait for the F.B.I. to make an arrest? I think most people are not against Mexicans but why do so many end up in Painesville?
jt. It is affecting your childrens education. I once asked a parent how her daughter was doing in the Painesville System? She said I don't really care if my child is bi-lingual only that she says at the same level as surrounding districts. It should not be part of the curriculum.

No the local authorities would not have to wait to make an arrest, but then again robbing a bank also violates local and State laws, being illegal does not, big difference. But, the charge would be taken away if the Fed's decided to charge that person, only if the crime met certain criteria. There would be no charges in the local courts, they would be dismissed and the robber would be transfered to the Feds. There is no local or State "Bank Robbery", I researched the computer a bit before answering. They could only charge with Aggravated Robbery and Theft or something like that. To get the big time breaking rocks, the Feds have to take over. But please don't forget that in the immigration code being illegal is looked at almost as administrative. They can be charged as a felon upon re-entry only. If it were a crime to be illegal they would get a jail sentence at the end of the trial instead of a bus trip. I do know that when charged with a criminal offense in con-junction with being illegal, they have to go through trial, serve their time, and then they are deported. That goes for any nationality. You don't want to hear what I have to say, but you know me, here goes.

Amnesty to all that are here now. Two years to become citizens and start paying taxes and being accountable to the government. This is paired with a strict border policy that includes fencing or whatever is needed to protect the borders. I think that if you made the population accountable to the gov't then we would benefit in the long run. I would submit that the cost of grant one time amnesty would be far less than the fight to arrest, hold, care for, try and deport every illegal here now.

I have no problem with immigration as a policy, as long as it is done fairly. My family was allowed into this country with not much more than a signature through Ellis Island years ago and I believe that the dream of "America" is what brought them here as well. Who is to say that dream is any less valid nowadays then in the 1800's. Give people ownership and they will shine more often than not. JT

O.K. Here goes.
1. Anyone caught in this country illegally is incarcerated, and deported. PERIOD.
2. Anyone employee caught employing an illegal, no fine. 30 days in jail first offense.
3. The same rules that Mexico has for people who enter Mexico illegally.
The Chambers of Commerce, Employers, will fight you tooth and nail. No jobs no illegals.
impractical? There are over 12 million illegals here.
What would this government do if 12 to 20 million taxpayers didnt pay there taxes? Say we can't do anything theres to many of them. Right

I think #2 is a bit rough for a first offense. Maybe bump it down to a second or third offense. Plus how do you prove they knew they were employing an illegal?

How do you catch them as "illegal" random green card/citizenship checks?

To localize the question, what can the city of painesville do?

Have you ever heard of E- verify?
Everyone arrested should be held by Painesville Municipal Court fot 5 days with ICE being notified.
Stop employers you will stop illegals. Terms on the right track.

How do you know who to hold for 5 days? Everyone?
Because if I am falsely accused of something I would be quite angry about that 5 days just for them to know that I am and always have been a citizen.
What if the charge they are arrested for doesn't even carry 5 days as a sentence?

Still this is in the court system not the city. What can the city of Painesville do?

"Buford" what are you talking about? How has she interfered? Name a few instances she has interfered with and how you are in a position to know what happened. What do the Painesville police have to do with the immigration issue we were talking about? Are you trying to change the subject? Why don't you tell us your plan for the immigration issue?

Right now you just look like a mudslinger with nothing substantive to contribute. Vindicate yourself with something worth while please.

If you get picked-up for speeding you most prove if ypo have Social Security number or a green card, worker visa. If not ICE is called and we will hold them 5 days. If ICE doesn't come maybe we could take them to ICE. Whats really important is having a City Government that looks out for its citizens. They should want to know whose living in this town. This administration is so lax it isn't even funny. The leadership always takes the easy way out. 75th out of 76th. now there something to hang your hat on.

What if I can't prove that at the time I get pulled over? Speeding is not a jailable offense, but if I leave my wallet at home I get jailed and hauled over to ICE?
Talk about a waste of resources.

This is something that is likely unconstitutional. The city government can't do this and it is not their jurisdiction to do so. I'm all for solving this problem but I am not willing to ignore my rights under the constitution to do it. Before you say they are lax give me something they could actually do and are failing to do.

I think a lot of these people need to study history, America is built on some basic freedoms. The ideas most of you describe violates those freedoms and takes us back to a time in history that reacted to ideas like that with a revolution.

Well I sat back to watch this post implode and it did. TERM, I see that you slammed my proposal, thanks for that, but you missed some of my other suggestions. I won't get into them as they are printed above. I did not merely suggest to use the one prong of the plan, but hey, it's all in the perception and not reality right?

This is a quote from above. I agree with half of this, can anyone figure out which half I am for...Yeah the ID. As to the other half, this is not the old USSR and like the poster above me, who has the right idea, most of us need to realize that this country is based on certain freedoms.

I called the Lake County Jail and asked the person who answered the phone this question. "what do you do with potential illegals". Guess what I got an answer, weird huh? Anyways, they said that they inform ICE right away if they get a suspected illegal alien and ICE places an "INS HOLD" on that person for a couple days until they get out to interview them and verify their status. After that the rest is up to ICE and no one else as to what happens next. They use government prosecutors that handle things and make the decisions because that is what they are told to do.

So I guess that calling a verifying facts still works in this country. After reading the posts here I expected to call and find out that the jailers policy was to let them out the back door, but they don't. Nothing sensational here to report and people are doing their jobs so I guess no one would say that they were wrong. JT

Some have told me I am to hard on the illegals, and I would tie up to much Law Enforcement. Thats true. Why can't you arrest employers? If 3 or 4 end up in jail watch how fast they stop hiring them. Every month we send 2 Billion Dollars to Mexico from people who are here legally and illegally. I wish I knew how it was divided between the two. I just wish more people would realize how important their citizenship was. You won God's Lottery to either being born here, or coming in "LEGALLY"

Now re-reading it, it's a slam on my "OPINION". But I repeat, my opinion was more wide ranging that just to give the amnesty remember.

And arresting the employers is not going to stem the tide of hiring the illegal alien at all. The labor is cheap and money talks in this country. Does the possibility of getting the electric chair stop murder, NO. It is just punishment. Do my kids not do bad things because they will get punished? NO. My point here is that one thing I have learned over the years is that penalty does not stop a problem entirely. So fine them heavily and hit the business man where it really hurts, in the wallet. Because we will pay for their jail stay also remember. Sanction their business, landscaping company huh? I have an idea. As Judge, I would make them cut the grass at the parks or have a list of elderly lawns to cut for them. Put a little back into the community. Might work, might not, worth a try.

Never once have I denied the fact that I am lucky to be in this country at all. I have been abroad and know how other countries live with different style governments, we are very lucky. And to clear the air I am a history buff, amateur I will admit, but I enjoy history, thanks for recommending that I do more reading...JT

JT, yes the Sheriff Department will call ICE on any illegal jailed there. But they have to get sent to the jail first. That's where the breakdown is. The Painesville police do not care about immigration status and won't hold anyone for that or call ICE.

When Painesville police arrest someone and they go to jail where do you think they go? They go to the Lake County jail which is run and staffed by the Lake County Sheriff's department. The police and the Sheriff's department don't go around arresting people on suspicion of being illegal. It is not their jurisdiction. They arrest them for committing state and local crimes and jail them whenever possible. They do everything they can and everything they can was laid out by JT. You are lying when you say they don't care about immigration status. They do care, talk to the cops, they will tell you. They care plenty but can't do anything because it is on ICE to do it. So they bust them for whatever they can and try to hold them until ICE can come get them. If ICE drops the ball that is on them not our local governments or police departments.

Well said above poster. I guess it's ok now for the police to go around and just arrest you for whatever they want, even if they are not allowed right? WRONG. Go to the police station and ask them if they can arrest a person for being illegal. Hell, call a local lawyer and ask them, maybe you know one?? Take the time to do the research before you make a comment like "the police don't care and won't hold someone on that". That comment is the epitome of what is wrong with this country. People making comments that they no nothing about have no basis in reality and then placing blame on someone not here to defend themselves.

I made the calls and checked and feel good about what I said. Now you made a great move, you just slapped the Painesville Police right in the face, nice. I for one would not have said that unless I had a clue. I hope that things work out better for you in the future and you are capable of seeing the glass half full my friend. JT

Nobody is trying to harm the city here. People just have different ideas about how to handle it. You don't need to attack JT like that. You aren't suggesting anything and that is ok but you aren't providing any intelligent conversation either. To me its a federal issue and not for us to be solving here. Maybe we should be discussing it on the other blog where the national election is being discussed. There we could discuss which federal candidates would solve this problem and how they should solve it.

It's amazing to me how often discussions end because instead of intelligent conversation regarding ideas, people resort to insulting the poster themselves rather than expounding on the viability of the ideas. Attacking the person is the quickest way to ruin a discussion. Most were too willing to attack JT rather than explain exactly what happened before or present viable alternatives. If we are trying to come up with idea to help the city and you ruin the discussion then you are the one selling out the city.
