Attended the swearing in process at City Hall.
All three swore to support the Constitution of the United States, Constitution of the State of Ohio, along with laws and ordinances of the City of Painesville.

Joe Hada was re-elected Council President, Paul Hach was elected Vice-President.

Council meeting over by 8:00PM nothing earthshaking.Everyone got there award. Councilman Werner was told his three minutes were up. Councilman Flock informed council if there was something important to do with Ward 1 or the rest of Painesvilles residents to be informed about he would ignore the three minute resolution.

Oh, I did hand the city a written request to view the citys contract between AMP-OHIO
and Painesville on the Meigs County power plant. Ohio Sunshine Laws.

One more bit of information if you are transported by Painesville EMS your insurance, medicaid, medicare will be charged $905.00 plus over 13 cents [SORRY THIS SHOULD BE OVER $13.50 per mile] to take you to Tri-Point Hospital, the rates were frozen at last years level. Stay Healthy!

Andy didn't second his request for Vice-President which was Hach 6-0.
I will let you draw your own conclusions on why Andy voted for Hal for President.
Robert Fountain did not make an appearance at the council meeting, and I don't remember anyone asking him to be excused from the meeting.
The two new members were seated at opposite ends of the table. I don't know if this is protocol or not?

Have any of you fed the homeless, given a coat to a kid without one in the winter. Help someone across the street. Of all the things to worry about. No government is not perfect and you may not agree with everything. The way you can help Painesville is to help those less fortunate. Things will work out, they always do. Have faith!

Maybe the leaders of Painesville should go on the News Herald web site. and view all the bad comments about the citys shooting and stabbing over the weekend.
Just maybe they will get the idea this city AIN'T safe!

Hey Term, why don't you run for council? You know everything about this city and if you don't you will look into it and come up with something. I think it would be much better than being the armchair/backseat politician that you are on this site and as a bystander at the meetings!

I found a document that provides a summary of the meeting that stopped construction of the Meigs plant.
It is written by the city manager of Oberlin.

Highlights of the letter:

"Based on this information, the AMPGS participants recommended termination of contracts with Bechtel (EPC contractor), Powerspan (SO2 emissions technology contractor) and Hitachi (turbine and boiler manufacturer). The AMPGS participants did not recommend termination of the power sales contract. Instead, the AMPGS participants recommended and authorized AMP to immediately begin technical and economic feasibility planning to convert the AMPGS project from a pulverized coal station to a combined cycle natural gas station that would provide intermediate power needs for the members. In addition, the AMPGS participants recommended that AMP pursue market power purchases on behalf of the participants to meet their baseload needs between 2014 and 2020."

..."It is important to note that reconfigured project would require a modification to the power sales contract by all participants."...

"So, what does this mean for Oberlin? Since Oberlin is not a participant in the project, we will have no exposure to the sunk costs in the AMPGS project. Our only expense is related to the developmental costs that occurred over the six year development period which was approximately $65,000."...

Another thing that worries me is whether or not we will get accurate copies. I don't trust these guys.

I am sure that my multi-tasking abilities will pay off someday, for now I focus on what I can do. Constantly complaining about something does not make it get better either. I think you provide a good service hear as most do not have the time or resource to do what you are doing. They and I, come here to be informed and I know much more that is going on around me, and I have you to thank for that.

I wish you could channel all of your efforts into one direction and make a difference. Why not run for council? Seriously, I have heard it suggested here before, I would vote for you. JT

I requested to view the contract, I have a pretty good idea what sections I want to view. I also asked to have printed documents of how the city uses the formula to come up with the power factor on our bills.
No desire to run JT. to old.

So I watched the council meeting on TV last night. Was waiting for Flock to ask for those meetings between us and all the other cities concerning response times.

As usual, he just made grandstanding comments so he would LOOK like he was doing his job, but didn't actually DO anything.

Oh, look at me. I'm Andy, and I can't actually DO anything because none of these bad people will let me.

Is he still just a waste of time, or is he actually going to do something this time? I'm hoping something is going on behind the scenes that I don't know about, although if that was the case, I'm pretty sure he would have mentioned it.

Seconding a motion or just vote YES to everything, does not make a good council person.
I will bet councilman Flock has had talks with other leaders in the mentioned communities, and as far as a waste of time hes probably the only one in the administration they even want to talk to.
Mr. Flock will go and talk to any community representative that will listen.
If he did it your way you would complain the oversteped his bounds my not letting the administration try first.
This is to big a problem to grandstand, and I am sure he will do everything to find a resolution to it.

I don't doubt Flock cares about people in Painesville, but what we get from him is dramatics and not action. I was hoping, as I said, that he was actually going to DO something this time, instead of just talking about it.

I certainly am not saying that the OTHER council people are any good. They are the ones who got us into this mess.

Term, you said that you bet Flock has had conversations with other communities about this. If so, let's hear about it. I was ready to back him for once, but all I see is more of the same -- him sitting there talking, but not actually doing anything to fix anything.

If he is so concerned, then I am waiting for him to initiate the meetings. Certainly nobody else has done anything.

I want Flock to stop blubbering and DO it.

I will tell you one thing politics and governments for the most part move slow. I am not privy to conversations he may or may not have had. I do know he has reached out.
Some of the comments I have heard off the record from other community leaders about trying to deal with Painesvilles administration would make the hair stand on the back of your head. Meetings planned then not attended, there way or the highway.
To be truthful it seems everyone is a little vary of dealing with us.
The problems we are now facing with Tri-Point didn't just appear overnight.
This past week at work we have made up some test orders from a new customer. Why? To see what might happen. Did the fire dept take and run test runs out to Tri-Point to even have a clear idea what the turn around time would be.
How a council president can address the citizens about 19 minute response times to near by areas such as Chestnut St. proves someone wasn't on the ball.
It didn't get like this overnight and it will not be corrected overnight.
Lets give it a chance.

The question I would ask councilman Flock is how do you control your temper and keep your sanity dealing with the people he has to deal with?
Werners about Werner, Hach hasn't a clue, Fountains never there, Hada is bullheaded, the city manager runs the show, why?
Maybe the new councilmen along with their degrees, will have a little common sense also.Along with the backbone to go along with it.
They have been dropped into a mess.
Lets only hope they won't get as discussed with the prcoess as councilman Flock has become.

I understand your points. However, it was two weeks ago that Flock said he wanted to have meetings with the other towns. Has HE done anything to initiate those meetings? Or is he still sitting there making his "poor cobblestone" comments and waiting for McMahon and/or someone else to do it?

The only thing good I can say about the others is that they realize that we need to worry about the WHOLE city now and not just Cobblestone.

Andy sat there while the others got us into this mess. Now he mentioned that we need meetings with all the other communities, and we certainly do.

I appreciate what you are saying about Painsville not playing nice with the other kids on the playground. Certainly this is a problem. That is why it probably WILL take Flock to accomplish what we need to have accomplished.

He's had a long time to try to get something done inspite of the rest of council and McMahon, and he has not done anything yet except give it lip service.

He is not a baby being held back by a dominating mother. Certainly he is in a daunting position, but it is time for Flock to understand that he is ALSO running this city. He needs to start doing something now. If HE does not do it, I do not see it getting done. It's too long overdue.

Again, I think he needs to stop talking about it, and actually set up those meetings. It's not just his job to sit there and go along or disagree. He actually needs to take charge now.

I also think that we need citizen involvement now in any important meeting. We simply cannot trust these city leaders. We just simply cannot trust them. We cannot trust them to tell us the truth or to do the proper research as it concerns anything that is of any great importance to us. In particular, I am now speaking of our EMS response time problem and our AMP-Ohio problem.

We need to have meetings held in public, and at the very least, a public question and answer session at the end. I am not supposing that the public needs the ability to address those participating in the meeting during the entire meeting, as there will be much for them to discuss and work out among themselves -- a real work session as it concerns the EMS problem for one thing.

I do believe, however, that the public needs to be involved now. It is my opinion that McMahon, Hada, Hach, Fountain, Gurley and Horvath (gone but not forgotten) have destroyed this city just about as much as we can let them destroy it.

We are left with Werner and Flock. Without Murphy or someone else in there, we are on ice so thin, I can hear it cracking as I type this post.

I won't even speak of Werner. Waste of words. And if Flock refuses to quit his whining and actually DO something for a change, then somehow the citizens need to find a way to do it ourselves. We must see it and hear it for ourselves. Actually, even if Flock does get involved, we still need citizen involvement from now on.

We need to see if they are having an intelligent, cooperative meeting with the surrounding communities concerning the EMS problem for one thing. We simply cannot trust them anymore with our money and with our lives. I think it also goes without saying that we need citizens at the meeting coming up with AMP-Ohio to discuss our options now that the coal plant is defunct.

The only way I know the hearing is on 01/27/10 is that councilman Werner brought it up at the last council meeting. Thats all he mentioned no time or place or if it was a public meeting.

I am tired of the Flock bashing...and yes I am a staunch supporter of Andy. And even if I weren't, I can separate the message from the man and keep my personal feelings out of a situation that calls for dealing with facts alone. I would hope that people would remember that we just went through the holidays, and everyone knows that government practically ceases to function then. Term is right...government DOES work slow but your imput would spur things along. Since everyone on this blog has access to a computer and telephone, then start calling and e-mailing the councilpeople...I've posted their addresses and e-mails on this blog before....but you can find them on the 'City of Painesville' site. Let them know you want action taken, ask questions and just generally make your presence as voters (and the source of their paychecks) known. Inform other people so that they can do the same. I realize that not everyone has the time or ability to go to council meetings and/or speak, but if you have the time to comment here...then take the time to send a message to each and every council person. Oh and don't leave out the county commissioners since they are supposed to have all of Lake County's interests at heart.

Cher, your so right. When this amp-ohio mess finally reaches the citizens of Painesville as to what an expensive mess they have gotten us into. The great Joe's and Rita will not be able to say, "We all thought this was a great project and the proper thing to do."

When they built Cobblestone who was against that?
The 3.9 charter change that would of raised property taxes over a million dollars back in 2005 for the homeowners of Painesville and could esculate yearly who was vocally opposed and voted against that?
As far as I can see there has only been one councilman that has done his homework over the years, and that was Andy Flock.
Maybe instead of bashing him people should start listening.
On a final note the council that served when the city hired the present city manager, only one councilman voted against her, wonder who that was?

I appreciate what you are saying, but I WAS presenting the facts alone.

I live in Ward 1 (Flock's Ward), and have been waiting for him to actually DO something -- for how long? -- almost two decades now?

He spends a lot of time PRETENDING to do work, but doesn't actually do any. I have found that there is nothing that can be done to make him actually do work, so I WILL be surprised if this works, but I am hoping it does.

He had two week to do something about setting up meetings with the other cities. Notice he never mentioned it at the last council meeting. He DID, however, make his grandstanding request that he wanted to amend the previous council meeting's minutes to say he wanted the Cobblestone's residents to have a HEALTHY New Year, too (and not just a HAPPY one). Give me a break. If he is so worried about them, he can set up the meetings.

There is no secret that I do not like Flock, and I have stated some of the reasons why above. That was not the point or the focus of my posts. We need him to actually do something now, and I want him to do it -- not just talk about it.

He's the one who sat there while we got into this mess, and he is the one who brought up the fact that we need meetings. What did McMahon say? -- something like "we're in ongoing talks"? Obviously, we cannot count on that, and we need someone on the "outside" of their group to be watching over this now. This leaves Andy and the citizens. You can see where McMahon's "ongoing talks" have gotten us -- in big trouble. Andy said he would be willing to meet with everyone involved. Oh yeah? Then put a meeting where your mouth is, Andy.

We'd better just focus on the needed meetings. Don't get me started on Flock. Trust me, I have only begun on that subject. This is yet one more time I am looking to him to do his job, and I do not see him doing it. He keeps running for reelection, so let him stop with the dramatics and actually DO someting now. The city needs him. The city really needs him now.

I failed to comment on part of your post. You are right about the commissioners. Where are they? Clearly Painesville has failed miserably in providing for our protection, so where are the commissioners?

Also, I HAVE personally fought this city for almost two decades now with absolutely no help from Flock. Not only that, but I can actually pinpoint at least one time that he actually sabotaged my efforts to help my neighborhood.

So, Andy -- call those commissioners!

What I have found out about any council person is it takes at least "FOUR" to get things changed.
Again, if Jesus sat on council and had the same support from the other six he could tread water like Flock. I have always found Andy to be honest and maybe you want B.S. Instead of the truth.
Please do not put all your eggs in Flocks or Terms basket call some of the others. Explain what you want. and find out why they will or will not support it!

The other council members are NOT doing anything, therefore it is falling on Andy to do something. He can make those meetings happen if he really wanted to. Anyone who has been paying attention could see that the others have gotten us into this mess, and they are not fixing it. I also don't think it's fair to continue to ask the citizens to do Andy's job. The citizens have been trying and it is not working. People need to stop sticking up for him and start expecting him to do his work.

I have not found Andy to be honest, either -- anything but, and I am talking from personal experience. That is not the topic I want to pursue here, however -- but since you brought it up...

Also, his honesty is not the main issue here. The main issue is that our citizens are in trouble, and we need his help. I'm not saying that he is not in a daunting position, as I have said before, but he is the one who keeps running for the office.

P.S. to Andy: Tell the commissioners that we need and deserve those meetings to be public now.

P.P.S.S. to Andy: Mary Poppins has a good idea. Call Werner and the two new councilpersons and see if they will help you in your endeavor.

I spent part of Saturday night reading the contract between Amp-Ohio and Yellow Springs,Ohio on the internet. Under Amp-Ohio is the citizens action site, where I viewed there copy. I'm sure Term and a few others have viewed this contract. Please tell me did Hach, Fountain, DelaMotte, Hada, Horvath Becks, Flock even read this?
After reading that contract I would guess only Flock read it considering whats in it,I understand why he voted against it.
This contract puts liability on Painesville until February 28,2057 I'm not an attorney but if this is the same contract Painesville signed,sorry we owe at least $3,300,000.00 plus interest right now.
Please read this and then watch how our leaders try to sell it.

We need to have any further meetings with AMP held in public. We can no longer let our city leaders handle this matter without our oversight and input. We cannot trust them not to get us into deeper trouble.

Anyone have any idea when the meeting is with AMP that McMahon talked about as she was being so evasive to Cimaglio at the council meeting? I hope it didn't already take place.

Anyone?

I have no doubt in my mind that McMahon, Hada, Abby, Hach and Fountain knew exactly what they were getting us into.

If Flock DID NOT read this agreement, and the only thing he did is to vote no, shame on him. If Flock DID read this agreement, and the only thing he did is to vote no, then shame on him. He should have done everything in his power to inform us completely about what they were getting us involved in -- up to and including jumping on the council meeting table if that is what it took.

He's not off the hook in my book and neither is Becks.

IS there any possibility of getting HADA out of office with a recall? That seems like a good place to start to me.

Jumping on tables? If you watched the meetings where was your out cry? Where was the News-Herald? Theres been more information about that contract on this blog. then anywhere else.
Your government is only as good as you let it, always expecting someone else to carry the water won't work.
Those council meetings should have been packed with concerned residents. I'm starting to believe as long as the lights go on, the streets are plowed, the school is open everything in Painesville is well,Great!

Again, everyone is expecting the citizens to do council's work. It's a given to me that we cannot expect the truth from Hada, Abby, Hach, Fountain and McMahan.

Your point that there has been more information about the contract on this blog than anywhere else is proving my point.

Flock and Becks should have read that contract and informed the citizens what the heck the other people who run this city were getting us involved in. The reason Flock doesn't do his job is because there is always someone there to make excuses for him. He is the councilperson for my ward, and I do not appreciate that. If he doesn't know by now that McMahon and the others cannot be trusted, then he should.

And by the way, I've done plenty of fighting this city on my own and by also being involved in several groups who have fought this city.

I refuse to take responsibility for someone else's job.

Again, IS there a possibility of getting Hada out on a recall? Do you have any knowledge about that?

Andy had meeting after meeting; in his driveway, at the library and the torn down schools and the same people showed up over and over. He was in meetings in downtown Cleveland, he was in meetings with Ohio Citizen Action who diligently tried to stop this mess before it ever got on the table!
It's you who are out of touch. Your dislike for Councilman Flock has made you blind.
Some of us don't show up at council for fear of retribution from the city and it's unethical inspectors!
Term has taken more than one hit for his objections about the way this city is headed and the schools.
Talk about walking into a den of snakes!

Our houses are devalued, our kids are dumbed down, our emergency response sucks, business in downtown is all but gone and the rent signs just keep going up.

So what is your plan to get the word out to residents of Painesville? A blog? Maybe one for each councilperson? There is a lack of communication in this town that very irresponsible.

It is not my hatred of Flock that makes me blind. It is everyone's blind support of him that makes everyone else blind.

And I, too, have suffered retribution from this city for fighting it.

I think we probably need investigations into what has gone on here and what IS going on here as it pertains to McMahon, Hada, etc. I'm sure they all need to get out. My point with Flock is that he sits by and lets a lot of it happen that he could have stopped.

He's good at holding meetings, but that's where it stops. His supporters support his non-action and non-work and let him get away with it.

As for me, I will continue to do his work for him in Ward 1, like I have been doing for almost 20 years now.

At least everyone is mad enough at me that they are posting some real truths about McMahon and the rest on this blog. That's exactly what needs to happen. One thing I think I know about her is that she left town in quite a hurry years ago before she was brought back for this position.

So, I'm outta here. I'm sure that will make you all happy. You guys just keep supporting Flock for his non-work. I'll watch for his next teary show which, of course, will be followed up by non-action. Your continued support of him is hurting this city, and it is hurting my neighborhood. It is obviously not going to change, though. He puts on such a good show for you all. He really SHOULD have been in the movies. He's very good at it. You just keep supporting him, and I'll keep watching the city tank. Poor, poor Andy. He'd really like to do something, but big, bad Rita just won't let him. (I'm talking baby talk now.) Flocks blind support?
Here's a different way to look at it, At the present time Flock is the only horse we have to ride ast the present time. So according to you we should all beat him with a whip?
I am sure you have issues with the city, the question to ask yourself is, how many of these problems have been caused by councilman Flock?
I will listen to any that have
been caused by Flock.

Councilman Flock sits at the table alone, last time I watched channel 12 he got one vote. Talk about salmon swimming up stream in flood. I've watched CM throw him under the bus a few times!

The election Horvath lost and Werner won I stopped paying much attention because I was pretty sure every vote that went to council was going to be 4 in favor of what CM wanted and 3 against. But then Hal wanted to be embraced by the councilmen with stars on their bellies and decided to do whatever the star bellied councilman wanted him to do so he could have a star on his belly too (Hal, wake up, it's never going to happen). Until it came to the illegal population and, well you all know that story.

Used to be a Hada supporter but good heavens he is a bullheaded deviant jerk who does not play nice or even attempt to play nice. Heaven help the council person who disagrees with him! Out to the woodshed you will go or maybe Columbus! If this Amp Ohio boon-doogle blows up in his face I will be the first one signing the petition for a recall and one to fire CM.

So you're outta here? Gee, way to wage war Napolean-blown apart! Way to retreat to the shadows of ward 1.

Okay, 8:13, I get your point, and I think your "Napolean-blown apart" is hilarious. So maybe I'll stay tuned and help you all clean up this town. But once it's done, I'll be trying to make a clean sweep of Flock, too.

I'll tell you a little story about Flock before I try to let that subject drop for now. When I first moved here, there was a wonderful woman who lived in this neighborhood named Venita Waters. I really liked her, but more than that, I had great respect for her.

Goodness knows that when I moved here, I had no idea I was going to have problems with this city, let alone such huge problems. But there it was, and I had to deal with it.

After fighting for some time on my own and getting nowhere, I went to talk to Venita. Venita told me that I had a Ward 1 councilman named Andrew Flock, and it was his job to look after our neighborhood. I was very happy. Told her I would go to him for help. She asked me to let her finish her story before I ran off to call Flock. She said that nobody -- nobody at all -- had ever been able to get Flock to do his work, and she did not anticipate that he ever WOULD do his job.

Venita helped me come up with a plan, but I also contacted Flock for the first time. She was right -- he was useless. And he has continued to be useless to this day.

And Term, I never said that Flock was the INITIATOR of a problem, but when you have a job to do and you do not do it properly, especially when you can see things are so terribly wrong, then you ARE responsible, too.

But I WOULD hate not to be a part of it when Hada and his gang finally get booted out, and I have great hopes for getting McMahon out of our government and getting someone else in there that we can actually trust.

I also think Term's blog is one of the most important endeavors I have ever seen.

Three things:

Does anyone know the date and time of the meeting with AMP? Has it already taken place? If not, is the public allowed?

Does anyone know the time limit, if there is one, on a recall? Let's not run out of time.

I would like to see these people (McMahon, Hach, Abby, Fountain, Hada, and probably Gurley, too), along with all the transactions that have taken place since they have been in office (personal and city business), investigated before all this is over.
