"IF YOU DON'T KNOW ME BY NOW, YOU WILL"

Interesting facts came out at the council meeting tonight. Councilman Andrew Flock brought up safety issues at the Cobblestone Development.
Response time averages 9:14 seconds. Thats unreasonable. period.
When the agreement with Grand River Fire Department fell apart did the administration inform anyone on council? He and at least two other councilman were unaware of the deal being void. Why?
Council President Joe Hada at the last council meeting stated "The communities must work together to solve these problems."
Coucilman Flock produced a document between the City of Mentor and the City of Painesville which stated Mentor would agree to be first responders at Cobblestone.average time less then 4 minutes. Now drumroll, guess who refused that, and stated will take care of it ourselves. Yes Painesville City, I'm starting to understand who doesn't work together. When the City Manager asked Mr. Flock what documentation he was refering to he show it to her. She stated she didn't know that was in the agreement [?} and stated council voted back in 2003 to I quote "Do our own thing"? Its just a good thing "doing our thing" didn't cost any resident any harm or the city may have faced civil and or criminal charges. If councilman Flock aquired this document any lawyer could also. Council voted 7-0 to fix this situation.
Something tell me we haven't heard the end of this.

Over 9 minutes documented? I can't believe the city of Mentor agreed to be first responders and the Painesville, refused it, or didn't know about it.

Flock seems to play dumb quite often like he didn't know what was going on. Maybe he isn't playing.

Where did Flock get the document? Why would any one councilperson know more than another. Was Flock on council back then? If so why was any of this new to him? If he knew why did he wait until the meeting to bring it up? How long did he sit on this before bringing it to anyone's attention? If he knew and let those people go one day with a slow response time then he is the one committing malfeasance.

Either way I can be sure I'm not getting the full story from Term.

Positive side: they are fixing it. I'm happy if they do everything they can to fix it. You can't ask more than that at this point. If Flock was the catalyst for that then a thanks goes out to him but I hope it was done at the earliest possible time and not just brought out to grandstand at a meeting. There would be no problem with getting it fixed before the meeting then grandstanding about the great thing he did, but he didn't do that.

Sorry, any malfeasance should go to the City Manager, Fire Chief, and possible the Law Director. All these people are professional that should know better.
Maybe Mr. Flock had to wait to get all the documents before he could proive the allegations?

Yes the blame should go to the CM and maybe the law director, but I'm sure the fire chief got his people there as fast as he could at any given time. But you should get your language straight. I'm not ready to call it malfeasance if it was possibly misfeasance. Get out your dictionaries. After you get your dictionaries out then get your facts straight and we will get the whole story. I suppose it could have been a mistake and I am not willing to jump to the conclusion that someone intentionally tried to harm those residents.

very interesting council meeting monday nite! councilman flock should be commended for his action in bringing this out in the open. and the city mgr. and the law dr. should be held accoutable for not informing the residents of this massive problem!!!!!!! if i lived at cobblestone apts. i would be screaming and yelling at the top of my lungs to do something immediately to help the residents. this is unacceptable and will not be tolerated by our elected city officials.the residents of cobblestone apts. should come to a council meeting and gripe like heck and get some answers to this problem. it won't go away on it's on. a concerned citizen of painesville city

When I heard about this I picked up my phone and waited 4 minutes,then I waited another 5 minutes the last 5 minutes I was angry thinking my child or mother could be waiting that extra time. When a unsigned agreement was the only reason I was waiting. The question is why?

Painesville's CM was the negotiator for a "1st response agreement" to protect Cobblestone. She had been having meetings with Painesville Twp but quit going to them. Her former remark that "the City of Mentor did not want to be
1st responders because they were mad over the Diamond Ctr Drive issue" holds no water. Mentor offered and she turned them down. Grand River did have an agreement with Painesville: but, they also had an agreement with Painesville Twp via the Twp's equip and manpower at the Grand River station to be 1st responders in certain areas of the Twp. Grand River then negated any agreement with the city of Painesville because it would conflict with their responsibility to the Twp.
As a matter of record, in 2003 these apartments weren't even under construction/just on the approved record to be constructed. Another little known fact was the meetings of all fire chiefs in this county with a firm that assess (by major blocked-in high residential areas through-out Lake Cty.)which community has stations that are close and would be more adequate at meeting the 1st responder time frame. The assessment is in draft form at this time and all chiefs have viewed it.
Per a local prominent attorney, regarding feasance, and defined here briefly:
MIS - Doing anything improperly
MAL - Doing anything that is in
violation of a law or
statute or against an
ordinance or regulation
NON - Just plain not doing
something that your are
supposed to be doing

There was a council meeting a few months ago when Mr. Flock asked the CM who was the 1st responders at Cobblestone. CM's response was "Grand River". Not so
CM, as this agreement was well past the termination date.

No other public entity gives their appointed CM as much power as this council allowed her to place on the ballot (way back when) during a spring special election. From that point on, she had the reins and placed the roller-bit in the mouths of council - horseman language for gaining/having tighter control over how the equine walks/trots/runs - every snort and every ney ney.

Quite personally, I see malfeasance and nonfeasance being committed here. Letters and meeting minutes are quite clear on this one.

Pushing the blame on council or calling out a councilman who said he didn't know anything about it, but voted for it? How do you not know about something he voted for?

If you think the city would be held libel for their actions at Cobblestone. I am sure the law director O.K.ed the deal no matter how they voted. Its less hen 1% of all Painesville emergency calls. The same people complaining about how Painesvilles leaders handled this would be complaining everytime Mentor sent a bill. Grow-up time to join the real world.

So John asked you to post it? Maybe you need to disclose more about your relationship with him so the blog is aware of the bias. I doubt anyone else would ask you to post about their fundraisers anyway. I doubt you'd block all comments. Anyone else but murphy you'd lead the charge in insulting them.

High Tech is not only one of Painesvilles top ten, I can't think of any business that brings as much good publicity to Painesville.

No. what I notice what makes a good councilman is just vote the way Hada tells you to, Bob, Abby, Paul you don't even make it appear to not look fixed. If your happy the way Painesvilles been running for the last 27 years you will have a chance to make it 32 years in November, I've seen enough.
I just don't understand the fear of Murphy? Maybe he would expose things better left covered up?

The issue here is when does the city and taxpayers want to do the right thing, which is simply build a 2nd fire station in the Heisley Park/Diamond Center properties. Why should we rely on other fire agencies to service our community? Show me a comparable city that has just one fire station servicing its jurisdiction. Painesville Twp has a similar population, geography, they have three stations.

Instead of the chronic complaining about response times and mutual aid agreements, find the funding for another station and the necessary manpower and equipment that is needed vs. depleting another entities public safety forces.

Issue Number 11111/911 is the exact fact that the P'ville City Manager (Rita M) has neglected and shoveled out the door the protection (rescue/fire) of her stolen "Land of Oz" within the 400 acres taken from Painesville Twp.
2003 council vote to take the responsibility for the Cobblestone apartments was voiced as: We will do our own thing." Check the records and the letters and you will find that this area has had no protection up to, not only 5/4/09 but up to this date of 5/8/09. A recent vote to fix the issue on 5/4/09 was implemented.Where in the heck have you council people been? You sit there and collect your $6,000 per year - you let her do your work as none of you ever question her methods. Council - you are the CEO's of this city/you were elected to not only represent but protect this city. All of you take the word of the CM as it is written in the word and granite. Guess what folks, she has made the greatest mistake in her lifetime and you Voted for it and Neglected it. If any of you do not understand this, go back and refresh your mind and read the ordinances that you all rubber-stamped for your CM.
As Rita M. has always been the negotiator for this area and also the negotiator in other areas - where is the trust for all of you or for her? How can anyone trust a City Manager that has neglected vital services to an area of this City because she could never ever gain a helping contract and just wished/hoped that an assessment of all rescue/fire services would be approved.
Sorry RITA, you have been exposed as a totally negligent CM. You have not accomplished the most important part of your job.
Rita, you have a choice. Resign now and relinquish your job to the assistant City Manager (Doug Lewis) or face charges for mal and non feasance.
Do not take the City Fire Chief aside (as you did at the 5/4 meeting to scuff-up blame). The blame is all yours - it is called gotcha.
Your realm of power is over.
We will be most happy to provide a musical band behind your city payed for car as you exit the City of Painesville.

Many of you listen to negative things about John from a group who is out to dismantle his credibility with misinformation they choose to have you believe with no research. Yes there is a John R. Murphy who's address is 127 Chestnut St., yes there is a John R. Murphy who has several police reports in his name, guilty as charged, but not the John R. Murphy who is running for council. The John R. Murphy in question is his son. Shame on all of you for having to dig and retrieve false material on a candidate.
Whomever your leader is let him/her know all you had to do was look at the date of birth and shut-up.

It is so obvious that all of you are "lost in space" when it boils down to the political workings of government. Never mind 1st responders or mutual aid - there is no reason why a new Fire Station cannot be in the Heisley Park area. Why there? The New Road to No Where - which is being constructed on land that is so wet and a part of the Mentor Marsh. Look all around and see the tall Grasses. These specimins are the same grass that is in the Mentor Marsh and only grows in the ground that is saturated with WATER. Good place for a fire/rescue service - spin your tires/kill your engines to get through the water that creates deep Mud. As most of you do not know, this area was not reccommended for any development: but, the city of Paine just pushed it forward.
So onward. The whole point is that Rita the CM has allowed the Cobblestone Apts (in Painesville) to be without any fire/rescue protection from June of 2008. She has been neglectful in her job duties! If any of you neglected such an important area of your job, it would be BYE.
It always takes time to discover evidence and bring it to the top. In this City there are way too many subjects that are not disclosed and are hidden. Thanks to those who saw/discovered the inadequate job performance of the CM and brought it to attention.
Rita is guilty of going against an approved City Ordinance and also Guilty of not performing her job as she should do. Again, how as a negotiator can she allow a section of the city to go without proper first response and then not tell the truth when questioned? This is in the minutes folks, ask for a copy.
So be it, and may this not be at rest until Rita faces the charges that are due her.
We will never (as before) trust any words from Rita the CM nor any words from the council advocates to her: Joe, Abby, Paul, Hal, Bob Fountain who they escort in because he is too ill (shame on J Hada for this) nor the Hurly Gurly man that twists the words of all
for their protection.

The end of the Earth for this group is right around the corner!!

Its not personal if you have watched this person time over time bend ,lie about the truth. Sometimes not telling the whole story is worse than a lie. I question this persons leadership and wonder if she is cometent to run this city. She has done more to Neglect Painesville then anyone in the past 50 years.

I doubt the majority of the people posting here are qualified to judge how well Rita has done her job.

You are not her boss, Council is, she answers to and does what council directs.

If you don't like something you should fire council(vote against them).

If Council is happy with the way she is doing her job then she is doing exactly what they have instructed her to, and expect her to do. Soooo, is the problem Rita or is the problem Council members?

How many of us are in the same boat, do what your boss wants, keep your job.

So are you saying 7 people are running for council and 6 say Painesvilles future is blah,blah,blah, and the seventh one says this town needs an overhaul and I will never give the city manager a vote in favor of keeping her job, or since I'm her BOSS I want 5 business days to look over any legislation she sends me, or I don't vote. No pay raises until the economy improves, ask for legislation to cut water, and sewer bills 5% now. Change the city charter to relieve the city manager of some of his/her power. Plus we will have a road improvement program inplace and I will cut Administration costs to get the funds if I can't get them anywhere else. Really work to have a better policy with our neighbors Mentor, Painesville Township, ect.
Also get the city to enforce occupancy ordinances. That candidate probably would be a big vote getter and separate him from the school system herd. Watch what you ask for.There's more discord in town than you think.

the same joe hada started a housing task force committee with paul hack, chairperson and abbey delamottee and andy flock from the council. they dont meet any more because paul hack said there really is not any need for any future meetings . this was said after the council meeting. a painesville resident.

I think council should be a non-paying position. That way we could get people on council that would really care about the city (not the their pay check) then use their money for the roads and to plant flowers

excellent idea, from the last post. we could also fill some of our vacant properties if the employees of the city would live in the city where they work!! the average city employee earns $60,000 a year.lets all work together to make this a great city.we can if you live where you work! a candidate.

You have to be kidding, how many people would want to put up with all the crap for $6,000 a year. Outside of possibly one council person I do not believe any of the others are doing it for the salary. Now on the other hand ask me if they are doing it for some other reasons, i.e. power hungry, possible kickbacks or opportunities and you may get a different answer.
