"THE 458 STORY"

A house was purchased in the last week or so by an Hispanic gentleman at 458 N.State ST. It is a 3-unit Apartment House. He recently informed renters they had 10 days to vacate there apartments, and he thought the units were already empty. This after he received their security deposits at the bank closing. He informed one renter he would only rent to Mexicans because of the language problem? He has been reported to the Fair Housing Commission this passed Friday. His plans include making it a 4-unit building.{Zoning anyone]. Also he is building sleeping rooms in the basement {Building Permit.} The water has been shut off.the steps to the basement removed.{Laundry Room}. This is the stuff that has to stop ENOUGH!
I will watch Councilman Flocks interaction with the proper Departments at City Hall. To make sure all Ordinances and Codes are followed. This is not the first housing deal like this in town, but I am going to keep the Citys feet to the fire on this.
Without someone bringing it up to them we will have 25 more like this in a year. Who's in charge. Will revist this in a couple weeks to see whats progress has been made.

If he has been reported to the Fair housing commission then good. I think we should follow what the commission does with this.

The funny thing about this fantasy story, is that the back yard of this property connects with city property. The owner name is well know in Painesville and his Uncle is a Judge, Go chase fire trucks or something, your getting on my nerves.

just because the building department is supposedly watching this renovation doesn't for a minute mean that some issues are not being overlooked for this homeowner. Selective enforcement is the mantra for the officials in this town, and I now want answers to this 458 N state situation. As someone who has been forced to comply with all ordinances to the letter of the law, I want everyone held to the same standards. What judge is the uncle of this homeowner?

Could you please tell me what the gentleman being Hispanic has to do with this?, and why did you put that in?, we have had Caucaian landlords running rental property like that in this town for decades and no one has complained.

You say this is not the first housing deal like this?, what are the others? If you are not willing to post the locations you have no right to make that accusation.

And just for your info, a Councilman is supposed to by our charter go through Rita, not directly through a department head. I wonder, if Flock ignores that will you post that on this site also?

Wait, are you telling me a City Councilman can not talk to the Police, Fire, Chief and even the head of Parks and Recreation without the City Manager being present? Councilman Flock should talk to the City Manager about this but he might violate the City Charter? Whats the point in having a Council I thought she worked for them.

How many people that come to this blog and complain about our city officials have ever bothered to read the City Charter, Codes, Comprehensive Plan, City Managers Reports, etc?

It is great people want to be involved, but do it right, be informed and then be involved.

Here you go, copy and pasted right out of the city charter. And, guess who reviews the charter for changes periodically?, a citizens group. And the council and city Aministration are bound by law to stay within these guidelines.

SECTION 12. COUNCIL NOT ADMINISTRATIVE.
Neither Council nor any of its members shall initiate or request the appointment of any person to, or his removal from office by the City Manager or by any of his subordinates, nor in any manner take part in the appointment or removal of employees under the department or division heads. Council shall approve the appointment or removal of any department or division head by the City Manager. Except for the purpose of inquiry, the Council and its members shall deal with the administrative service solely through the City Manager and neither the Council nor any member thereof shall give orders to any subordinates of the City Manager, either publicly or privately.

If the house is currently multi family it is grandfathered in as multifamily.

If they are putting in additional sleeping quarters in the basement and you want to stop it report this to the fire department, the fire regulations deal with proper means of escape and they can declare it non-conforming to life safety regulations and no zoning or building codes can over ride that.

Again, I ask everyone, take the time to learn our charter, codes, etc. some things are mandated by law whether we like it or not, others we can do something about. If you know the difference and can reference cahrter, code, etc. you will gain much more credibility.

All you should have to do is report a problem,and have the proper authorities handle it. All I think Term is saying people are changing garages, basements into living quarters and when it is then reported the Citys answer is we have to have probable cause to investigate. Maybe if we stop it at the start it will stop. I have a home near me on Liberty St. I wish I had reported 2 years ago before things got out of hand.Think about it 4 apartments in one house? Do they have 4 electric, gas, met

Yes JOJo, You hit the nail on the head. It will be easier to stop it now than in 6 months. The reason I brought up the Hispanic Owner was he told a tenant he was only renting to Mexicans. I verified this story the best I could, and I stand by it.

Not sure where Jojo has been but 4 apts. in one house is common in this city, some of the big old houses have 8 or more.

And all of this funded by our wonderful County commissioners who continue to let section 8, extended housing, etc. pour the bulk of the assistance money into Painesville instead of insisting it is equally divided amongst all cities in Lake County.

They tell us we should consider ourselves lucky we are getting so much of the county money, but in reality it helps no one but slum lords/absentee landlords and ruins our neighborhoods for those of us who are single family home owners living here.

When they published the results of the city poll for the comprehensive plan a few years ago one of the top items residents wanted fixed was the high number of rentals in the city.

Why do we never see council working on that? Clue, how many of them are landlords themselves?

How many of them are good friends with Landlords?

Wait, maybe we should ask how many of them have appointed landlords to committees and commisions?

How many illegal aliens could this city support if we DID NOT have such a high rate of rentals.

Besides our council welcoming them there are other items that draw them here, the availability of rental and the willingness of our wonderful landlords to rent to them and claim ignorance.

Once you go to four units, that requires a different zoning code. It may be grandfathered as a 2-3 unit, but not a 4 unit.

I have an update Term. Fair Housing did speak with a tenant, and told the tenant that what the landlords were doing was illegal. The landlords were contacted and one of them acted as though they didn't understand English. Finally another of the landlords was contacted, and they were told that what they were doing is illegal and they could be sued. The tenant has decided not to sue, and is planning on vacating ASAP.

The building department was notified today of the construction going on in the basement and the transition from a 3 unit to a 4 unit. We'll see where it goes from there.

Thanks Term for your advisements regarding every zoning negligence; that include every nationlity within the "Ville". Selected enforcement, yes and yes this does exist. After all, the Ville welcomes all regardless of their status and whether or not they can conform and assimilate to the rules/regulations/laws of any community.
Your posts are very informative, and they state the truths about the lack of of enforcement within the "Ville".
There is not one other City Entity within Lake County that would tolerate the nonsense within the Ville.
The majority of you who post here and negate his findings, obviously never read any papers nor watch any T.V. The "Paine" "Ville" has been on every T.V. station way too many times with so much negative reporting. Not one other public entity has ever been reported on major T.V. as has Painesville!!!
It is what it is; and the perception of this city continues to be the laughing stock of this county and many many communities beyond Lake County.
So sorry that most of you are blind to the disgusting abiss and shroud that is a fog around our community.
Maybe, just maybe, you will wake-up and climb out of your inherent fish-bowl and truly see the light. The light that is negating your rights - negating your property ownership - negating your property valuation - and absolutely tearing down the city that you feel has a wonderful/prosperous future of being something/anything in your dreams.
Come and shop and dine in the Ville.
What exactly are we to shop for? Taint anything here of importance. Dining here: how can you dine when the sidewalks shut down after 5:00 PM. I have friends in other communities that laugh out loud at Painesville's signs to shop and dine.
The reality is we shut-down and lock-down to protect what we have !!
What is posted here is REALITY. It is reality so that all of you (who do not participate) can see the truth.
If you want to know the truth, read what is here and get off your lazy butts and persue the realities; you will be amazed how the truth is really the truth in the "Ville".

Another accusation without support. What reasoning do you have to indicate that any enforcement is based on race? Is there some internal city policy you know of?
Just because one white guy gets the rules enforced on him and you see one hispanic guy slips by does not mean they are selectively enforcing by race. How many homes do we have in Painesville and you are going to tell me that violations don't slip by with people of every race?
Looks like you only want regulations enforced when they are regulations that seem to effect hispanics more than any other race.
Aren't they now enforcing the housing rules as soon as they heard of it? So where is the scandal?
If you were truly color blind you would have never had to say the landlord was hispanic. You could have said that the guy was violating the rule. It could have been a white guy only renting to people who spoke english. Either way it is a violation but you used race to demonize this guy. He is a bad resident, bad landlord, and a violator of regulations, and you still feel the need in interject race. Didn't you have enough ammunition on this guy?
I don't believe anyone is lying but I do believe it could be presented in a race neutral way if the presenters are color blind.

To agree above though, People should probably laugh when considering shopping and eating in Painesville. I believe our restaurants are better than those elsewhere in the county. Good food doesn't always trump national advertising campaigns though. I would pick the depot over anyplace else, but we do have a lack of selection. I can't eat at even the best place everytime. We should be focusing on how to bring busniesses to Painesville. I think the new housing developments should be obvious to businesses that there are people here who will consume their good and services. Thank the developers or whomever decided to put them there for creating the market to attract the businesses. If we increase demand supply will follow.

Again, The ONLY reason I mentioned that he was "HISPANIC". was he told the current tenants that Mexicans were the only tenants he would rent to. Thats why a resident called fair housing. A question I have is there a limit to the number of people that can be in that house? The rents has gone up from $420.00 a month to $600.00 One apartment was rented to a couple with 3 children,and the other to a couple with 2 children. these are 2 bedroom apartments. You can no longer go to the basement thru a door on the first floor, but an outside cellar entrance.

Painesville is the "Ville" because it is more simple to type the Ville than Painesville. Gotcha - because you do live in the Ville.
So, no name, lets here from you and your wonderful knowledge about the Happenings in Painesville (Ville). Tell all of us how wonderful life is in Painesville. Tell all of us about your taxes, all about the wonderful street that you live on, and anything else that you can drum-up.
I for one do not like negativity, but when it is there, it will be there and it is what it is.
If you so happen to live on an old street within this City - you will absolutely receive nothing! You will be the last on the list. How do I know this, because the direction of this City is all for everything new. The majority of new voting is 100% for all of the new developments and not for what has been here for years and years.

We moved on this street in 68 and no work has been done on it, but we love it, and it is almost all rentals, but we put up with it, if there is a problem we call the city dept. that will help, and they do, if we see code breakers we call code inforcement, if we see law breakers we call the police, we love this city, and there are ways to get things done, you guys should try it.

First of all these types of incidents aren't zoning negligence, they would be zoning violations.

Terms posts state the truth about lack of enforcement?, maybe I missed it, where on this blog has he ever posted any proven truth about enforcement?

As far as TV, you just notice more when your city is on TV, take out the floods and anything to do with us being the county seat or eastern lake county court and it is nothing more or less than anyone else.

I agree the News Herald posts a lot of negative about us, Many people in this city for years have contended that the News Herald is biased against Painesville.

If you are uneducated enough to feel you have to shorten our city name by 5 letters to sound like you are someone why don't you just start calling this your "Hood"?

As for the rest of your post, there are no facts to refute. Just a lot of misused english language. I thought I would never see anyone butcher the english language as bad as one of our councilmen, but you have managed to do it.

The wind is shifting, A lady from Meriden Ave. Exposed the City for what it is. Watch the Tuesday Council meeting and then reply. She handed Rita and her co-horts their lunch. They will try to attack some city residents, this lady pushed back. Watch the City Managers reaction, to bad she couldnt find a hole to climb into.People with common sense have had enough! The house at 458 state st. was purchased on the 18th of August.By IRENE & JORGE LLAMAS The house was built in 1900. 2 stories, 9 rooms, 4 bedrooms, 3 fullbaths, 2360Sq.Ft.
My understanding of 350Sq.Ft. per person means 8 residents total. All information given here is public record. The men working at the house had over 100 pieces of 4X8 drywall delivered Tuesday and I watched them take it in the basement. One worker stated the city works 9to5, we work 5to9.

But what they can't do is show up to the meetings , actually spend their own money and time to help other in the community, and be an influence not only to friend and neighbors but to the youth in the community. You may be correct about the man, but his attitude and methods to get change are totally out of line and repulsive to many of us the way him and the other "Negatarians" attack people without any facts, just knee jerk accusations.

A lot of you think just because someone means well or is nice they can use whatever tactics they want, you are so wrong.

Perception is reality, TERM, Murphy and the other Negatarians could very well be the salvation of this city but it will never happen as long as they continue to drive the negative perception of themselves.

I will not vote for a negative person, Andy will not get my vote again, he is quickly turning into a negative perception for his methods in battling the rest of council. He is totally right, but I hate the negativity.

Oh, I get it, put aside the fact that they had no citizenship, had no freedom, were forced into manual labor, raped, assaulted, sold at auction, and then try to compare that situation to the current situation with hispanics. You make a really good comparison! WOW!

Now you just have to come up with a comparison to the Jews during the Holocaust, and everyone will understand the plight of hispanics in Painesville. UNBELIEVABLE!

Salvation may require taking a positive action, not just pointing out what they think is wrong. The question has been asked on many occassion, What do you plan to do if elected and has gone unanswered? Even the people not running have been absent from saying "this is how the city should handle immigration..." or anything else.

I think there is a difference between slavery in general and the attitudes and obstacles of the abolishment movement which is really what the poster referred to.

First off, I am White... I don't like to speak for anyones race or nationality but come on, Comparing Slavery to Illegal Immigration it just doesn't work. Slaves were captured by Tribes in Africa, sold to White slave traders taken to the "New World" stripped of culture, religion,language,even family treated like a commodity, or worse livestock. This went on for over 200 years, then they were freed and had to put up being a second class citizen for over the next 100 years. and this compares to someone sneaking under a fence to do landscaping? Please do not show anymore ignorance here. Sorry I know I will catch alot of Hell for this statement,but its how I see it. Next we will compare Lake County Jail to Nazi Concentration Camps. I have been reading all the comments since this blog started. Let me say that I am relatively new to Painesville(almost 5 years). It is a great city to live in and raise a family. But...I have never lived anywhere there was so much out right, blatant prejudice. All this talk about mexicans and illegal aliens!! Why are you assuming that because a person is of mexican decent that they are illegal? The majority are actually legal. They work, pay taxes and spend their money in this city as we all do. Alot of the homes they buy are in run down areas "you" would never choose to live in but they do. So they rehab them and increase property values. This is what the majority do. Give me the hard working, family oriented Mexicans to live by rather than an ignorant, white racist. This particular landlord that everyone is complaining about, if the story is true, is no different then any other slumlord in Painesville. But you dont hear complaints about them because they are the "preferred color." In case you are wondering..No I am not mexican..I am white, not of hispanic decent! This is a wonderful city to live. What makes it so great is its diversity. Take advantage of it! If you want to remain prejudice and you dont like what goes on here..move!!

I'm educated and secure enough personally not take offense to being called a bigot or negative what I want is dialogue (discussion). The primary reason why people stoop to name calling is because we do understand the essence of each other personal views and opinions. Lets discuss it, if someone is willing (I know I am) to sit down, it doesn't have to be with TERM , just talk I guarantee you'll quickly see once know whom I am I'm not a racist, bigot, anarchist, or a revolutionary. To the gentlemen who call me racist I don't offense because your misinformed If you'd like discuss I'd be than happy to have lunch at Jimmy's on State St. and discuss just you and I.

This is not true at all. Read some of the other subjects. People complain about landlords and Painesville being 50% rentals all the time.

I have some close knowledge of what is happening at 458, and I must say, 99% of what was said on here is true.

Ignorant racist? If that landlord was white, what would you call the person that reported him? Yes alot of Mexicans come here for a better life, but if there are here illegally sorry they got to go. If you condone these actions I think you will be very sorry about sticking your head in the sand and ignoring everything around you.

Hey, 5 years, you got alot to learn. The Mexican population figures if you dont enforce major laws, why worry about little ones? If no on stops you from robbing a bank, Federal, State, Local. why should they worry about shoplifting. Its only building codes whats the big deal? Americans do a poor job of enforcing there laws. Right. This must be the only country on this planet where you walk into uninvited demand rights and intitlements and if you dont get them you scream racism.

Ok, I am totally fed up with the city looking the other way for certain individuals. Can one of you from the city explain how this situation is being allowed and who authorized turning a blind eye to zoning ordinances. I went over and checked this house out myself and something is definitely not right. City officials, comment. We are waiting.

Oh my gosh. 81 posts on this subject and all anyone can say; "You are a bigot/Racist."
As obvious, each and everyone of you have a computer. Google the immigration laws/rules of the many countries that these people come from. You will definitely find-out that their laws are 150% more strict than in the U.S.A.
When elementary school-age children (of other nationalities) tell us that there are no rules and they do not have to obey any rules, what does this tell you? Children learn by example from their PARENTS: and, at this rate, it will be a future of doing as we please when we feel like doing anything. This aso includes the lack of parenting from all of the parents that are a part of this country/ but feel that they are owed something. The illegal immigration problem is totally out of hand across the entire United States, not just in Painesville. We do not care how much money they spend, we care that they totally disregard the rules of legal/illegal residence, lack of assimilation to their new found environment, their total disreagard that they live in a country of great freedom which is earmarked by the Pledge of Allegiance to the Flag of this country (which they denounce), they do not stand-up in RESPECT to this Pledge nor do they stand-up in respect of the playing of the National Anthem as witnessed in the graduation ceremony at Harvey High, If you did this in any other country, you would not be walking/breathing for very long.
It has been a very known fact that legal immigrants house those of illegal status in their basements until they raise enough money to strike out on their own and rent and/or buy. Fact: we have 3 houses near us (N.State Str) that do this. Fake I.D's, fake S.S. numbers, numbers based on a foreign signed Matricula, and yes even a ITIN when assigned because you were caught evading your tax responsibility (due to 1099's) are the gateway to still existing as not being approved to live/work in the U.S.A. The fish-bowl that we spoke of on another post just states that everyone is in a fish-bowl and never can see what is happening in their respective neighborhood/city/world.
Respect out property, do not trash our property, do not torment nor hurt our pets/wildlife, do not ever urinate nor defecate on what is ours, do not ever tell us that you do not have to abide by any rules/laws that protect our rights as law-abiding citizens/property owners, and most of all (which is the accepted norm of your previous country of residence)do not inflict the lax laws pertaining to drugs and rape that you seem to see as an acceptable way of life. As for others that influx the U.S., you can have your religious beliefs: but, do not ever expect any of us to change our beliefs because you cannot assimilate to something that is different to you. Our country was not put together on a religion/nor premise that you seem to feel must pervail.
Most of the supposed new generation of young foks (sadly it is from 20 to 38 years) have no allegiance nor faith. If you do, please stand-up and be heard.

What all of you have at this moment may not be perfect in your eyes: but, if it wasn't for those that worked hard for this country, you would be out of luck and wandering around trying to figure out how you could have the freedom to choose your job, home, restaurant,32/52" T.V, a Blackberry, et al. These are not items that are free choice in any other country.
This country has always had legal folks that are in need (regardless of circumstance) yes even those that play the system: but, the illegal entrants into our United States now outnumber any of the above and are draining all resources. Google this, and you will find out the exact numbers.
It is not hard nor difficult to find the exact statistics - just do it so that you are now truly informed.
Call us idiots or anyone else on this blog bigots/racists, it is your right to freedom of expression. Just remember one big item; down the road when you have no rights left at all and when others demand this: remember this blog and all of the intelligent participants that tried to educate you into preventing our freedoms from being eroded and extinguished.

That long post still has a statement about how they outnumber all the legal folks in need. The one question I keep asking these people and no one can answer is if they are illegal and undocumented what methods are they using to determine how many are here?

It is not an accusation about a Nazi. It was posted in the newspaper that he was a guard at a Nazi prison in World War II with his wedding anniversary announcement last year. He has admitted to serving in a Nazi prison camp.
