"KNOWING WHEN TO LEAVE" the carpenters

Many of you on this site tell me to do something more than complain. Well, Tuesday morning I filed a recall petition against council member Paul Hach and council president Joe Hada. This is a direct result of the failed AMPGS power station in Meigs County, Ohio. Painesville's share could be as high as 2.7 million dollars. Painesville does not have the funds to throw this kind of money to the wind. I believe this money will be paid out of an increase in the "power factor" in our utility bills.
We know who is responsible for this loss yet the city holds no one accountable. There is no mention of where the money will come from. Others who voted for this no longer serve on council and Mr. Fountain has shown no interest in running for another term. Both of these highly educated people should have known better than to involve Painesville in a 50-year contract with AMP-OHIO. I was informed I would need 1,600 signatures from registered Painesville voters. That is another story in its self. If you see these council members, please ask them where Painesville will find the money for this latest blunder.

In 2008 the Painesville City Council passed an ordinance to participate in a [take or pay] 50 year contract with AMP-OHIO to purchase electric power from a plant planned to be built in Meigs County, Ohio ["the Plant", AMPGS]. As part of this contract, the City of Painesville guaranteed a portion of the construction cost of the Plant. Because of escalating cost relating to the fact that the Plant was to be "coal-fired," AMP-OHIO decided not to proceed with its planned construction, leaving the city to repay up to 2.7 million dollars. Many Painesville residents opposed the City voting to participate in the contract. The final council vote was 5 to 2.
Councilmen Paul Hach, Joseph Hada, Robert Fountain, Arlene Becks and Abby Delamotte voted to participate in the contract. No concern for the money lost by the City or the financial impact it will have on the City has been expressed to the citizens of Painesville. Current Councilmen Hach and Hada have been or were derelict in the sworn duty to the citizens of Painesville.

Most of the information that instigated this recall can be found in the February 19, 2008 council meeting minutes, as well as the October 14, 2010 council minutes meeting.

Democratic process is ugly. Elected representatives need to be held accountable. If someone came in to your home and sold your snake oil and told you it would keep your hair from falling out in 50 years would you buy from this person? If you did buy from this person should you be allowed to make purchasing decisions again?

Government is tough, I am not saying people do not make mistakes, but the problem with these particular council representatives is clearly the sum of money that was lost. 2.7 million. That could have paid for Mrs. Arcaro's water line on Elm street and still painted the inside of the water tower.

I think what grinds me the most is that when this legislation was passed back in 2008, Hada voted 'proudly' for this.. like that is some kind of big statement to make.

He and Hach do need to be held accountable for this, time to act is now. Do not wait!!

I just hope you have learned from Arlene's petitions. If you recall, it was a unanimous decision that her petitions were invalid.

Also, who to blame if a petition is ruled invalid. The Board of Elections is made up of members from both parties. Let's hope you don't go around blaming just one party or citizen who just happens to belong to that party.

I would like to know which people running for council this year support this and will sign it. Any person that will sign this can look else where for my support and can be assured I will actively campaign against them, my ward or not.

8:07 Lets clear this first item up. The POC had nothing to do with this recall. Just me.
The BOE of Elections gave me all indication that the petition was valid now getting valid signature will be another issue.
2:45 Can you explain your comment? I guess my question is your fine with someone lossing over 2 million dollars of Painesville money? This waste at city hall must stop. people must be held accountable for mistakes they make. What exactly is your objection?

It never ends. The threats just keep on coming. I will sign whatever I want and any candidate running for office should do the same. I would wonder about a candidate that would not sign this due to your threat!

Well, it will be very interesting to watch the democratic process in action. Term has every right to exercise his privilege to ask for a recall...procedures are spelled out at the local, state and national level. It's in place for a reason. And signing the petition does not necessarily mean that you would vote for it....it essentially means that you would like the VOTERS to have the opportunity to decide for themselves. $2,000,000.00 is a lot of money in my book. And just because the two council members went along with everyone on the last AMP vote doesn't get them off the hook. They are the remaining council people that voted for the original deal. And if I'm not mistaken....AMP-Ohio is still trying to get its members involved in different projects....so let the folks that will end up paying the bill send a clear message.

Wouldn't it have been refreshing if Hada (and Hach) would have stepped up at some point and admitted he (they) made a mistake? Now they're going to take the heat for a recommendation from the person I really hold responsible....the city manager. I think its time all council members get serious about finding out where all our money is and how it is being spent. Also time to seriously re-examine the city manager's performance.

I would question why a candidate wouldn't sign this petition? It's just a chance for voters to make right a mistake that has been made. Any candidate who would not understand this is a big mistake that could have been avoided doesn't have my vote period.

The bottom line on Hada and Hach, they gambled with tax payer money on boondoggle of a project!
and they did it proudly........

If we do not have money to pave roads, do really have tax payer money to gamble on anything?

2 million dollars could have paved 3-4 miles of roads.

Well your sorta right the only two things you can do with profits from the power plant is spend it on the power plant [improvements, expansion, or sell your customers cheaper electricity? All which makes little sense to me?
Painesville power can not show a profit to be used in the general fund.
If anything comes out of this it will be to show Painesville residents what makes up the 'power factor' of your utility bill. I can only wonder the sins buried there.

This may not be approved because it is not legal.

If you grouped both Hada and Hach on one petition it is not a legal petition. If you separated them Hada could go through, Hach will not.

Painesville states our recall follows State Statute for recall, State statute says a local official cannot be recalled in the last 190 days of a term.

12:13 I don't know. I drop the petition off Tuesday morning at the BOE they looked at it and said they would take it over to the Lake County Prosecutor's office. I was called a few hours later and told I had a valid petition?
It's not beyond the scope around here that an anonymous poster on this blog. knows something those two departments don't. I will call first thing in the morning to find out. Thanks for the heads up.

All this recall will do will make members of council very careful of what they are voting for. I am sure none of those seven councilmen had any idea how this could blow-up in their faces. Can Paul or Joe ever again look at people in Painesville and ask them for their trust?

This deal had nothing to do with the Gorsuch plant that the EPA fined Amp-Ohio for is it? I remember at the time Painesville was to pay their share of the fine which was around $85,000 where did the money come from to pay this fine?

Hey Term why are'nt the police doing anything to clean up the streets? two weeks ago there was a little girl on liberty st that almost got raped and the next day the cops let the guy out and then he tryed to rape a 89 year old women that day and then they relized it was a good idea not to let him go. Today some guy tryed to break into an apt on Liberty St. the cops cought the man but the people that live ther never heard what can of it and there is always homeless panhandling in downtown? If you can't awnser this can you tell me somebody who can????

12:13 I think your right. I reread the law and what you mention was in the law. This post should have been "Knowing when to file". I will check with the BOE this morning. Ultimmately this was my mistake. The recall may go away for a while, but it will be back. Along with me doing everything to bring this information to voters before election day.
Thanks to all who were helping get signatures and to those of you who have already signed.
Just maybe this might wake-up this community to the waste that goes on.

to post 7;54 they are two council mrmbers left. They should and will be recalled NEXT YEAR. Paul Hach should have a interesting community picnic sept 10 2011. He better have ALOT of FOOD. some one who is waiting to sign the petetion next year.

Politics is an interesting game. Now I find out a high ranking Painesville City School administrator is seeking a Board of Education seat in Perry? You would think this person has enough responsibility with their job without taking on added jobs?
It strikes me odd how many public employees cross-over and run for office in their own towns? I guess what goes around comes around.

TO post 11;28 do you think PAUL HACH is going to run for re-election. he can only hold office a short time if he even wins in ward 4. Because of the recall pending. they are alot of residents upset about the 2.7 million dollars loss and has to be repayed to A.M.P. OHIO. He is smarter i would think.

There are no pending recalls. Once petition is submitted, required signatures gathered, signatures check to see if they are valid, and the recall is placed on the ballot. Then you have a pending recall.

I have seen a flyer mentioning it is to be held at 1034 W. Jackson St. September 10, 2011 1pm to 3pm.
This confused me because on the same date the city is having a city picnic at Recreation Park 1pm to 4 pm.

Yes, it is most definitely time to look at that power factor. I use electric to heat my home in the winter. With higher usage, the rates go down on part of the bill, but the power factor does not and it is wiping me out. I have not been able to figure out why in the hell would my bill be so high -- especially when they keep bragging about low rates. Now I find out there is 10 million dollars in an account that nobody knew about except for them? Investigations, investigations. When we get new people in office, I know there are a thousand things for them to look into, but I hope our electric rates and this power factor will be looked at as soon as possible. Just one more huge sum of money in this city that makes no sense. Investigations, investigations.
