I guess there is pain in loving Painesville?

One thing nice about living in Painesville; chances are you will never say, "now I've seen it all" because there's a chance with every drive home from work you will see something new....while our city manager fiddles with downtown "Streetscapes" [painting cross walks red?] Really Ms. McMahon? We, here in the north end, have something I guess we could call "Garbagescapes"? After viewing this late Friday afternoon I called my councilman Andy Flock to take a look.

Andy dutifully checked it out and he couldn't believe his eyes. A call was made to the "Golden Dome' and Assistant City Manager Doug Lewis went to the scene and told Mr. Flock he would not authorize overtime to clean up this mess due to Painesville's present financial situation. Mr. Flock said something should be done due to this being a safety and health issue. Mr. Lewis mentioned maybe if you would have called earlier? Mr. Flock informed Mr. Lewis we both work and he notified the city immediately after I informed him.

Now Mr. Lewis... a thought: that garbage must have been sitting there for more then a few hours. With Painesville's Public Works building just down the road you would think someone, anyone, from any number of city departments passing by that mess (police, electric, water, streets, parks, community development) that someone would have reported this? Is that a result of what happens when over 75% of your employees don't live here?

The update is that there is a full roll-off there now. I have no idea who finally authorized it but sure appreciate Mr. Flock getting the ball rolling.

I posted this for two reasons: in case residents on Casement, Bank, Cumming, and other streets can't understand why they can't sell their house or that no one seriously wants to move here... this house is appraised at $81,000. Think it would sell? Look at how out-of-towners on their way to Silvestro's or Chester's will view Painesville? The other reason is: if a resident is thinking about moving... he might think he can just just throw his garbage out like this guy. What, no retribution? This could become a common sight.... like cars parked all over lawns.
The city administration must realize we expect results when we pay an assistant $93,000 a year. We also expect residents and landlords to know there are consequences for their actions... even after 5:00PM on Friday.

Not to excuse the City but wouldn't you think one of the NEIGHBORS would have reported this? It's disgusting. Be interested to hear from neighbors of this house. Maybe they did complain and it fell on deaf ears.

Oh Term I know exactly why I can't sell my house on Casement.
Let me count the ways the city has abandoned tax paying home owners!

Let's see, Streetscapes only took 2 years for the city to decide to paint the crosswalks red, I hold out little hope for things like this to be resolved.

Sure isn't my view, not even on Casement who is looking at a neighbor with 7 ducks, 3 -5 cats, three dogs and a pack of kids loose at home with no supervision for the summer........

Oh and then there is the abandoned house 4 doors down the guy died in ....... yeah Casement is lovely this time of the year.....

Earlier in the day there was a man there. A U-Haul truck was parked in front. My first thought was

"Looks like another renter skipped town and left garbage for landlord to clean up."

So, was this an eviction or a foreclosure? Court records will show that. Was the landlord the one that called for dumpster or city? Landlords must wait before they can legally regain access to their property. So who put this all on the curb. I doubt Andy, Term or the ones being kicked out started cleaning out this house. I have seen sights like this on my street more times that I or anyone else would want to see in a life time.

My bet, landlord just got access and just started emptying the house. More than likely, he call for dumpster after he found out how much junk was there. City would never have reacted that fast.

Sorry, don't think our Dynamic Duo of Term and Andy get the pats on the back this time. Landlord/owner just had not finished everything in just one day. Don't think I could have either.

So the landlord just started throwing stuff out, left then called for a dumpster? I guess the minute he walked in he would have known he needed one. My guess Friday trash pick-up Monday let it sit there untilv someone complains about it. Paul Hach never did squat for the people in that part of his ward and I for one am pleased with Flock as my councilman now, as well as Term for keeping the city's feet to the fire

Isn't there an ordinance that explains you can't put your garbage out more then twelve hours before pick-up? This person who ever left it there had no intention of getting a rolloff. Look where the garbage is stacked.

Well, seems to be a case of eviction. Couldn't find it on Chestnut but read about house on Chester. Went there Sat. afternoon and things were cleaned up already. So, in less than 24 hours the owner cleaned up his tenants mess and put things in dumpster and garbage cans. I think he did a reasonable job in a reasonable time frame.

Term, just how much of this credit goes to you and Andy? Looks like you just wanted credit and another chance to take a shot at city. You name names and cast blame before the all the facts are in. Same with the credit you give to yourself and Andy.

I believe this owner had a mess thrown at him from his tenant and did his best to clean things up in a timely manner. You on the other hand took political/civic credit and you just wanted to cast the rest of the city in a bad light.

So what does this little post add to the perception of Painesville now.

Sorry about the Chestnut St. I must have had that street on my mind. You may be right about the tenant and the landlord did take the right steps. I find it hard to believe that if Mr. Flock didn't get involved when he did the mess would have been taken care of in a timely manner.
Who took political or civic credit? Me, Andy I don't think that was the case. I told Andy and he went to who he was supposed too.
What does this post add to the perception of Painesville? How about truth along with a dose of what many residents presently put up with here in Painesville.

What day is garbage day here. Very good question. Sounds like this wasn't there on Friday morning early. Garbage spread out in house then piled on tree lawn can look overpowering. Call and or shop for dumpster and dumpster actually being delivered can take some time. MOST owners want to clean up a mess like this as soon as possible so they can rent it again. Hence my timely manner reply.

What is it they say about dirty laundry and air. You mention how many readers you have and remember, once something is posted on the internet it is there forever. Pictures like this and over such a short time frame can be very misleading. If it had gone on for days or even weeks like mine have sometimes, then pictures to councilman, police and then made public at city council meeting first. Then posts here or elsewhere should be made. Just my two cents.

You can look up the owner on the Lake County Auditor's site and then plug his/her name into the Painesville Municipal Court's site. Pretty simple to find out who the owner was and see what he/she was up against. Whether he/she intended to clean it up quickly or not is debatable though....I would think the city would/should have been notified ahead of time so when Mr Flock called the-powers-that-be...they would have been aware of it already and been able to give him some kind of answer. I'm really amazed that out of all those city workers that had to drive by, none got hold of anyone that needed to know.

This might have something to do with the down fall of Painesville I saw a traffic stop Saturday, the police arrested the driver, and let her kids go with someone else,
come to find out she is an illegal emigrant, she has lived here over 15 years and has 7 kids (food stamps)
how much do you want to bet she will be released form jail when she goes to court tomorrow.
Wonder if Hal can do anything about this ?

2. If the Judge grants you restitution, should the tenant fail to vacate the premises or remove his belongings from the
property, you will have to file a Writ of Restitution by paying the Clerk of Courts the fee ($30) and filling out the
Praecipe for a Writ of Restitution (included in packet).
3. Upon receipt of the Writ of Restitution, a representative of the Bailiff’s Office shall contact the landlord or the
landlord’s attorney to set a specific date for the move‐out of the tenant from the property. The Bailiff’s Office shall
supervise every move‐out conducted through the Court.
4. In the event the tenant vacates the premises before the scheduled move out date, the landlord or his attorney shall
immediately notify the Bailiff’s Office (Ph: 440 392‐5873).
5. The landlord must be present at the premises for the move‐out. It will then be the responsibility of the landlord
to remove the tenant’s possessions to the tree lawn or to storage as the landlord chooses.

It works out best to move to the lawn giving the tenant a chance to get there stuff, and then have it put in storage.

I too, believe Term jumped the gun on this story. Jumped to conclusions without knowing all the facts. Sensationalism on front page yet maybe just the fact it took a little more that the time Term drove by and came back to take pictures to take care of mess. That gets posted on back page. Assumed owner wasn't going to take care of problem, yet he did. So is this a case of Term and or Andy using intimidation or just an attack against this owner because house is near Term? A public apology or just opps, I made a mistake. It is my blog and I can just say anything and post any picture I want.

Reminds me a little of the movie called Absence of Malice. Paul Newman was portrayed to be guilty but latter proved innocent. But he got even.

The ball is in your court Term.

Just putting something on the blog. doesn't make it right or wrong. I did what I was supposed to do, call my councilman who in turn did the right thing and called the administration who"s job it is to find out what's going on.
Ask any councilman does the administration inform council people what's going on in their wards?
Just think 10:55 if at least three more people had listened to the Dynamic Duo Painesville would be $2,000,000.00 richer.

Paul Hach? The only reason he even got on council was so he could get royalties on that gas well, and put a million tons of dirt in his back yard. Think the city would let YOU do that? What a poor excuse for a councilman.

I can see two sides to this issue. I gave up calling about garbage out from Friday night to Tuesday or Wednesday for a Monday pickup. For awhile, one rental just left the can at the street. I am sometimes happy to see a pile of garbage on the tree lawn. It means bye bye to another bad rental neighbor. A couple of days of mess is far better than what I have to put up with the rest of the time they are here.

On the other hand, this was not the case here. An eviction, looks like. Read 8:27 post. What if this had been a case of someones elderly parents who had died and family from out of state had to come in and clean up? We are in a growing college town. Ever go through a college town's rental house area during start or end of classes? Sometimes you need to work with people first.

The rental problem is the real issue, not this mess for a couple of days. Lets not lose sight of that problem. This battle was basically over before it started. I'm afraid we are still losing the war. You wish this was a better landlord. Well be careful what you wish for. You just could get another slum landlord. I wonder what the owner thinks of his neighbor.

Looking at these picture's I see nothing to do with an eviction. No furniture, beds, TV's only disgaurded junk. The story should be who is responsible for this litter? The rolloff should have been there before everything was thrown on the street. Looking at those picture's I believe councilman Flock did the right thing. It seem's the city also didn't know what was going on since the manager claimed not to want to pay overtime?
You all might have missed Term's second reason; If people see this is ignored why not do it themselves?
The city manager can put a wig, slipstick, and makeup on a pig but in the end it's still a pig.
Fixing what ails Painesville takes more then a few tree's and some red paint.

Get tired of Term as a neighbor, sell him that house and buy one of the houses on my street. That way you'll be improving my neighborhood and solving some of the immigration problem at the same time. If you evict a bad tenant, I'll even help you clean up the mess.

To 7:29 you bring up an interesting point in 25 or 50 years from now the residents who live here might have a name or two to put to how bad thing are, where it started and who started it. My best guess seems to be no schools will be named after Hada,Hach, Hanlon, or McMachon.

Thank you for documenting this. This event is exactly the kind of activity that occurs in PVille and is passed off as 'typical'. Much like when one of the commenters here said that water lines break and they 'just get on with it'.

Ask yourself, would this garbage mountain occur in Hudson? If residents leave property in this condition it is the land owners responsibility.

I agree with Term, this scene could become more common place as people become more transient.

Residents need to be vigilant and contact their representatives in city council when activities like this arise..

Yet Condos/New Park go on and on. I guess Term doesn't go this way to work. It would be nice to live in a perfect world that meets everyones expectations. Painesville ain't it folks. Some of you should drive around town first and end of month and look at garbage and tree lawns. While you are at it, Look at the single family houses with 5 or 6 of the big green garbage cans out front. Then you pray that there won't be a storm and blow the lids open. Then you get their garbage in your yard. Now it becomes your problem and you must clean it up. It's not in my yard anymore they say. If you don't, you become the filthy neighbor. Then you have to hope there aren't rentals like this all around you. Parkview??????

The tree lawn debris on CHESTER street started very small and then grew by leaps and bounds over a short period of time. What was there, was ignored by Waste Mgmn't. for one Monday pick-up day.
Fom there, it grew and grew. The owner was aware of what needed to be removed and should have made the call before he/she dumped it outside. As far as the folks on either side of this house, go find out who lives in those houses.

Oops, education and common sense is certainly missing in this situation and so many many many other areas in Pain'ville.

No, you are wrong, they were told not to pick up when there has been a move out, and yes this same thing happends in Hudson and every other city, when there is a move out, and flock and Term did not get the ball rolling it was already rolling this is how it works, all courts do it just about the same, get over it, this has happend on many of streets in Painesvill not just this one.
It is a sad time for whoever lost there home, I just hope the family or there kids don't see the pictures on here.

Agreed. There are many reasons for an eviction. Non payment and criminal activity are two that jump to the top of list. Hard to say here as court records don't say. They do show that tenant was charged with trespassing the day before pictures were taken though. Think about what someone else here said. A pile of junk on the tree lawn for a few days may be better than having to live with a problem tenant 24/7. Now if only more background checks and follow ups on more than one family in a single family home would take place, things like this might get better.

11:21 It doesn't for numerous reasons most of the items are being recycled, people are making alittle of bit extra money. Most people who do this are quiet don't make a mess. I know there are some that ramble through garbage and leave a mess. Most don't and are respectful. It's the bad ones that make the city enforce ordinances against this practice.
If I have some items I think someone might pick-up I try to leave it where they can get to it as easy as possible.

Thank you. I am one of the many that go out every night and recycle the metal that others feel should sit in the landfill for years!I dont make a mess and i try my hardest to be quit while I do it.

2:21 this is a big differnce there. Most scrapers dont dig through your garbage. I take the metal that people leave laying on they"re tree lawns. I am not going to pull up in front of your house and dig through your garbage can looking for the soup can you threw out. I am looking for the fridge,washer,dryer,stove, etc.... Now there are scrapers that do that and they also make me upset because thats why the police and the home owners look badly at SCRAPERS. Please just remember smoe of us out there scraping are just people that can't find a job trying tofeed our kids.

Fro time to time I've had to throw things out on the tree lawn that wouldn't fit in the garbage can. If I'm outside, the 'scrappers' always ask politely if they can have it...and if I'm not outside...I put a 'free' sign on it. I wouldn't want anyone rumbling through my garbage late at night but I agree with Term...help yourself.
