"WHATS YOUR NAME IS IT MARY OR SUE?'

I thought it was important to fill people who have posted on this site this information.
Yesterday around 3:30 pm a Painesville police detective showed up at my door. I was not home at the time and my daughter called me and I spoke with him over the phone.
He was following up on a complaint filed by a city employee and asked for access to the blog. to find out who posted under "Take Me Home Country Road" 7:02am and would I cooperate with the police.When I returned home I went back and reread the comment and called my attorney. He advised me under NO circumstances should I make my computer avaliable to them without a subpoena and even then file a motion to quash the subpoena. The Supreme Court has ruled that blog. site operator have a duty to not to disclose the true identity of ANONYMOUS blogers.
Having run this site for two years I have never received a violent threat concerning anyone. Well, that's not true someone waiting for me to get my meds at the drug store.
I can understand some concern after the planned attack on a Judge, City Manager and a Law Director a few years ago, but that comment didn't mention a person,address or a threat. The detective mentioned harassment and stalking. That I was told was a stretch. What Law was broken? The person operates a public business? This I feel was the police helping out a colleague and is somewhat improper.
The officer mention a city ordinance. Well detective the Bill of Rights supersedes any city law.
With all this said, maybe now some of you will understand why I don't really want to get to involved in gossip, or he said, she said. We have to many important issues coming down the pike that will affect all of us.We don't have time to be screwing around with barns and whatever.
I never knew a dozen people could cause so many problem?

I beleive it would be very interesting to google kathysak.com freelance writer and read the pages she has in her records section on first responders. The report that the city co-operated in.
I believe a lot of our questions could be answered.

Reading through the blog I don't see any threats. Not by the blog posters or the blog administrator.
Strong arm tactics on the part of the police is a cheap shot.

last time I checked we still had freedom of speech & the press.
There is great opportunity to banter issues back and forth. There isn't any other place to do that.
We have some serious issues coming down the pike and seems like some at city hall or on council might be getting nervous. Get ready folks the curtain is going to be pulled back.

and seriously if this is from an over zealous inspector thinking she is being harassed, she really doesn't know what the definition of harassment is.
I suggest the inspector look it up in the Ohio Revised Code.

and if the city is going to use strong arm tactics against a blog I have serious questions about who is sitting up at city hall; I thought Stalin was dead?

Gee, calling the police and making a ridiculous report about someone supposedly harrassing, etc. -- sounds like something Hal Werner would do. Maybe he's friends with the inspector and is coaching her.

Thanks, Term, for having your neck stuck out there all the time for all the rest of us and taking all the hits.

If this inspector, thinks she's going to go after one person and get some kind of revenge, or clear her name, or get some kind of monetary reward, then I hope she is sadly mistaken.

The fact that she has caused so many problems for so many people in this city is coming together on this Web site, and I'm sure she's none too happy about it. Sometimes the truth hurts.

It's my opinion that there are not very many people in this world who can have authority over other people, and handle it well. Most people just don't have good enough character, and they will take advantage of other people, or hurt other people, etc. This woman, from everything I have heard about her all these years, surely seems to me to fall under that catagory.
I'm sure many, many people have complained about her over the years. The big question is why wasn't anything ever done about HER?

Apparently this city employee only came to the conclusion that he/she was 'harrassed' after reading the blog...or someone else read it and told her/him about it. Seems to me that this blog must be much more effective than anyone could have imagined. Term....don't let this side-line you; please don't get diverted by the smoke and mirrors pointed in your direction. Thanks for being up-front about the situation and keep up the good work!

I wholeheartedly agree with everything you said. I don't think, however, that this is the first time that the city (if this IS the city) has used strong arm tactics against a blog, as I recall. Someone can correct me if I am wrong. I thought Term was very brave, indeed, when he started this blog. Still do.

I was making fun of the inspector and Hal Werner, not the situation. I think the situation is horrifying. Read the post again. Either I miswrote it (is that a word?) or you misread it. I don't think there is anything funny about what is going on in this city. This IS a tactic that Hal Werner has used in the past -- just couldn't help but point out the comparison. Maybe she learned it from him.

I went and read the post refered to. I may not agree with the inspectors tactics but I do think she has a right to expect the police to look into it. With the history of public employees getting attacked, the poster freely admits he thought the citations were "nonsense", admits he planned his actions to get on her farm and then used a "fake name". I can easily get to "stalking". If someone I dealt with at work did this to me I would call the police also.

People on this site can hate her all they want, but you should re-read that post and realize that could easily be a crazy actually planning to hurt her. I know a lot of people who post here and none of you would really want her hurt by a crazy person, you may want her out of a job but not physically harmed.

I think they will get that person, a blog admin doesn't have to give up the info, but if they go to the blog server owners and prove possible physical harm to a public employee as retribution for performing their job and ask for voluntary cooperation to get the info I will tell you the server company will give it to them without even thinking twice. They will not risk a big business over a small town blog.

My advice to 7:02am, start thinking about what lawyer you will use.

Hmmm...Re-read the post and also did not see anything that would warrant a police investigation unless someone just took a comment out of context. I guess people need to be more mindful of what they say when they "vent". Hope this is resolved soon - best to you.

What about Noel’s rights? She operates a private business on a private drive, not a store front. When she leaves work she is a private citizen and does not have to tolerate a low down snooper who is looking for revenge for her doing her job. Did you peep in her windows also? I would be concerned as well if I had the responsibility of the safety of someone else’s children and property by having someone coming around with a bogus name and for nothing good. Burning papers is all you came up with snooper.

Hey I got an idea for snooper 7:02, mind you own business, fix up your city slicking shack and you’ll have nothing to worry about. If you don’t like her make a complaint the right way. If you don’t like that suggestion then go out there and snoop some more and hopefully one of those parents out there with “fine tune” your snooper.

I think you are missing the point.
This is between "Snooper 7:02" and the inspector.
The blog really has nothing to do.

The blog is freedom of speech and freedom of the press.

Do you ever listen to some of the crazy people preaching from the pulpit or mosque or hell city hall (Hal Werner)?

Think Snooper 702 was extremely frustrated and just did some looking around. This is completely blown out of proportion.

I believe snooper 702 had no business snooping at that farm. They showed no scruples or respect.
Snooper should take his frustration out on his vegetation by cutting his grass. Term IS involved. He printed it, then he defended it and called his lawyer.
He is now trying to minimalize it to deflect his liability and responsibility. It might not be illegal but is it right? I am sure he or you would not want to be treated this way. Term's rattled and rightfully so. Keep poking the bear Term and see where it gets you. Probably in court.

I offer a question here, do Painesville City employees have their own private police department? I ask because this so called "crime" happened outside of Lake County? Were the local police of that area called in on this?
Painesville Police should worry about local residents as much as they do there fellow employees. Next time your car is stolen in Euclid call PPD, and they will investigate it?

The more I think about this the less sense it makes.

Let's see now. A post made on a Painesville blog about a Painesville employee because she made a inspection of this person's Painesville property. All three take place in Painesville so I can see why Painesville police were involved.

Over reaction? Probably. Makes me wonder thou about how bad things are becoming in Painesville. I remember a certain black woman making a threat of violence at a city council meeting awhile back. Roll the video tape. How about the Marine (received a broken jaw) attacked with broomsticks by the reported 20 Hispanics? Seems to me that frustrations with city officials are high and things are getting worse.

Three incidences of large fights/brawls between many people have been talked about here in the past. One was by the Post Office on Prospect St., one by Parkview Apartments and now the one with the Marine. Anyone else see the common denominator here? Can we look forward to more of these in the future?

Now here comes that word again, racist. Is it racist to expect your neighbors to behave and respect you and your property? As I have said in the past, my neighborhood has and is still going through a big change, for the worse. It was a mixed population of homeowners 20 years ago but now has changed to mostly rental. The neighborhood picnics and kids playing sports together is over and has changed to a constant flow of traffic all hours of the day and night of people being picked up or dropped off at these rentals. Driveways with one or two cars now have 5 or more and more parked in the street. Loud music and 15 to 20 living in some houses.

The racial remarks made by the Marine's mother's boyfriend is nothing to what we have lived with for the past 5 years or more. The thing is, it is directed by these renters at the few homeowners that are left on the street, not the other way around. Now we all know that not all Hispanics are like this and they are not illegal but if there are groups acting like this, how do we know the difference?

I bring this up because this city employee called the police because she is scared/frightened on her own property. Police are looking into this and we will see what happens. I would like ALL the city officials who don't have to live this on a daily basis to finally listen and stop saying Painesville doesn't have any problems. I believe that if the same groups of people we deal with on our own street came to her house or business, a blind eye would not be turned. She might even have 24 hour protection.

It is truly sad that it has come to this in Painesville. If you can't accept America as your home, why you care what happens to Painesville?

To anonymous at 3:53 and 6:38, contacy an attorney for what, because someone made a remark about the conditions of individual's property? I don't see any "stalking" issues here, someone obviously thought it would be interesting to if the building inspector for the city was as strict with her property as she is with those in the city. I think it is more along the lines of being a hypocrite than anything else. Yes, we all have a job to do, but based on the remarks written within this blog and comments throughout the city, there appears to be more of a case of selective enforcement which has irritated a number of people.

And as your suggestions for local residents to go through the proper channels to complain about her actions, well obviously it appears based on what folks have written in this blog, a number of residents have in fact complained and nothing was ever done to address the problem.

And Term, I agree with your remark that the the only crime that was committed is simply someone being overly curious and nothing more. My opinion is that someone is simply trying to stir pot and get a rise out of someone, and obviously they fell for it hook, line, and sinker. Furthermore, what a perfect excuse for someone to get the information of everyone who has posted "anonymous" and made derogatory remarks about the city and its leadership.

"My advice to 7:02am, start thinking about what lawyer you will use"...gimme a break, its called freedom of speech, so deal with it.

There were no visits to anyone's address. Apparently folks in the know who are well aware of the happenings at this person's residence spoke about the conditions there and felt someone should pay as much attention to their own place as they do with the folks of our fine city. A whole lot of drama for no reason at all.

Term, to change the subject for a minute -
I just got done watching the council meeting on tv, and I did not catch any mention of AMP, as far as how we can find out what the city owes them right now, BEFORE they may get us involved with something else with them. I also did not hear any mention of any possible meetings for council and hopefully the public, too, about the Closest Responders. I was sure that Flock was going to bring those things up, but not a word. Do you know of anything that is going on in these two areas that we do not?

Term, the only fallacy to the story was there no secret visits to this person's house. I have issues with selective enforcement practices (victim of same) and happened to be speaking with a friend, who has direct knowledge of the happenings and conditions of said person's proprty. I have no reason not to believe this person wasn't being truthful. As for remarks about "stalking" and "crazies out there", sorry I am neither. And for that matter, who is really the "stalker" here? Someone who writes a tale to bring some information to light or a vengeful person who routinely uses their position to harass and annoy the good citizens of this community while looking the other way at the slum housing throughout the city. No, I'm just your average joe citizen who is tired of the practices of certain folks for far too many years.

I would write more but I have to go tidy up around my around yard before I get another visit about my "vegetation" and "outlawed weeds". Keep up the good work Term, your blogs are raising some eyebrows in the city.

As far as the council meeting, we will apply for the nature grant, I believe $19,000 was mentioned, AMP-OHIO landfill gas proposal was put on first reading? How does that go fool me once shame on you....
A presentation on development and engineering, in the city. Also the city planner spoke of the importance of the census coming up. Other then that not much.
Council has a work session coming up next Monday, Councilman Flock will probably address the first responders issue then.
Badger, as far as Avon Lake someone with some "juice' must know the right people to get ICE to address that problem. No one in Lake County with the exception of maybe us "racists" care what goes on around here on that subject. A mob beating a man and breaking his jar, doesn't even upset the powers around here. Keep your mouth shut and head down dummys.

On Amp Ohio,
Watched the council meeting and the Amp meeting when we should find out how much we owe on the coal plant on the river, now defunct is March 13 or 15th. (mid March)
The new contract deadline for Amp Ohio landfill gas electric contract is March 31.

Can council possibly wait until we find out how deep in pile we are before we jump into bed with AMP again?

Term, just a little FYI before the conspiracy theorists take over here, but it appears this little incident spread like wildfire through city hall. The word is the person from the police department who visited your was never told to go there, and took it upon himself to do what he did. For that matter, the building inspector in question was told to file a report with their local pd. But, judging by the info in the blog which brought about this debacle, they were probably told to there was no crime there, except for the open burning complaining that was alleged. (Amusing to say the least) So, I don't know the reasoning behind this peron's visit and the request your computer. Who knows, maybe some overzealousness, looking for brownie points with the upstairs powers. Think about it, how much do you think the information in your computer is worth to someone who wants to know who all of the "anonymous" people are who post here and bash the city.

Anyway, time to get back to business, there are bigger issues in this city that need addressed than this. The city is in the process of selecting a new chief, hopefully some changes will be made in house.

Here is something that will make Doug Nagys head spin. Theres a new DJ on WMMS Alan Cox in the afternoon, I listened to him yesterday, and he was dumbfounded that there was a place named Painesville. He first thought it was a joke. [Hes not from the Cleveland area}. Then the callers piped in , you figure the rest. He claims he might come out to Nemeths Lounge but I have a feeling Painesville will have a regular spot on his show.

Term, I believe all you need is a reason to detain and ICE will respond. Someone just needs to make the call.

One other question I have is. Don't people who work in grocery stores and restaurants with food have to undergo some sort of health tests? TB? Maybe other tests. I wonder if these illegal immigrants have had all these tests. Are they current on other immunizations? Something to consider next time you thing the food is tastes great.

I don't believe for a second that someone at the police department took it upon themselves to go to someone's home and ask for a blogger's name, etc. Nope, didn't happen so please let's not blame the police. Damage control is fine - but don't blame the police. I do believe this whole thing spread like wildfire through city hall. I think maybe some people were very upset and perhaps over-reacted by requesting an investigation. I think the police were doing what they were ordered to do. Then, at some point, everyone calmed down and maybe thought - wait a minute - what are we doing here. Please let's not now start blaming the police. Yes, city hall will need to select a new chief. I can also think of some changes which may need to be made but those changes don't involve anyone wearing a uniform. Our police, our firefighters/paramedics are some of the finest to be found. As is usually the case, upper management "stuff" flows downhill to the working men and women.

I don't think anyone can say for sure if a policeman took it upon themselves to come to Terms's door or not. We're just speculating and no one can say for sure unless Term has more information now. Someone in the police department owes Term a conversation, if it has not already occurred (if Term wishes to have it). A police detective coming to someones door and asking for access to their computer is a very serious thing. I don't think people can say whose fault it is or is not with any certainty until the proper information is obtained, if that is possible in this city. This is pretty scary stuff for something that was as benign as 7:02's post, in my opinion.

We really must INSIST that they tell us the whole truth and nothing but the truth about what we owe AMP as of right now, for the failed coal plant, before they even start talking about getting into another deal with them. For one thing, it would be just like McMahon to hurry up and get us into another deal so the figures are obscured, and we won't know what is going on. And that could occur, of course, whether it's a good deal or not. Anything to cover their butts, I'm guessing.

Before rumors abound, the officer in question did not, I repeat DID NOT go Term's house on the orders of some higher authority. Someone called him and reported their issue with the blogs remarks and that they found them offensive (sorry, if the shoes fit young lady, then wear it). Being who the complainer was, the officer felt he had to at least look into the matter. And for that matter, what was the matter? Someone upset about comments about their residence? I guess maybe this person who was cited for such lowly violation, expected a higher standard, but instead got the politician stance of, "do as I say and not as I do" nonsense. And as for secrecy of their residence, "someone is stalking me", gimme a break. This isn't the Batcave we're talking about here. Everyone in the city knows this person as the "horse lady", they drive a big ole truck with their farm name on the side, it's in the phone book, etc..etc. Someone got a case of the "chicken little syndrome", which I hear has happened on more than one occassion. And suddenly their on the warpath..RED ALERT, RED ALERT, I HAVE BEEN OFFENDED..SEND THE ARMY, NAVY, U.S. MARINES. Unlike the problem children above, "you better have an attorney" ready", I found the blog in question amusing to say the least.

Anyway, back to the officer in question, he did what he felt was appropriate and I have no issues with it. A whole lotta nothing about nothing nonsense by someone who was offended about the remarks made about her. So to the offended party, go back to your office, you might want to run just in the case the sky truly does start falling and wait for the next bit drama in your life to unfold.

My understanding at this time is the AMP meeting is not a public meeting.

Pretty sure if there is money owed by participating communities it will hit the web and press.

The contract is public and you can read it if you have the time to muddle through it during a Feb. snowstorm. Pretty sure after reading it we are going owe, owe, owe........

will be interesting to see how this plays out.

Hey Term,

Last night around midnight we saw something wierd, a life flight flew out of Cleveland on there old flight plan over Painesville, came around over the old hospital like they were going to land, then it flew west toward Cleveland, it flew to around rt 44,then it flew south toward the new hospital, I sure hope it was not what I think it was ???????

Also I was at the gas station, by the old Hospital around 2 weeks ago and there was a provide a ride van there, the driver was asking where the Hospital moved to, he said they sent him to the old Hospital ??

7:15 I only let this post up to show people how ignorant you are. The people in this country grant more human decency to peoplethen any place on earth. Should we do the same thing the Mexican Government does when they find illegals living in Mexico? Clean your own yard before you come and complain about your treatment. Proof of your numbers are impossible to prove, and the question was how do the people know if these children have been treated. Your argument holds no water.

While this is a true statement it only takes one rotten apple to spoil the whole barrel. There has been a lot of discussion about perception. If you truly want to become productive members of the Painesville community then you would be against these illegal immigrants too. I for one, wouldn't hesitate to report a crime, regardless of who committed it. Illegal immigrants, 20 Hispanics attacking a Marine, 15 or more unrelated people living in a single family home, or groups of men living in vans behind houses usually with only one bath doesn't portray a good impression to anyone.

Instead of hiding behind the word racist, St. Mary's Church or Veronica Dahlberg, why not get involved with the community. Have any of you offered a solution at say a city council meeting? Have you tried to embrace the American way of life that offers so much to anyone who is willing to work hard AND become a productive member of our society.

A certain song says

"O'er the land of the free and the home of the brave!

That means you are free to work hard for everything you want and not demand that you are entitled to it for free. Home of the brave refers to those who are willing to fight and die for these freedoms, like the Marine that was attacked by 20 people.

If you want to enjoy all the freedoms and privileges our great country has to offer then you need to embrace it. We are a nation of immigrants who have all come together to make America the great country it is. What's your problem with this? Want to come here LEGALLY and add to our way of life, then I support you. Sneak in and hide in the shadows and show little respect for my country or me, then I have little respect for you. I know many people who came to this country from other countries as a first generation. They didn't expect special treatment. They were happy to be here. They didn't give up their heritage but learned and added ours to theirs.

I have a family and taught my children honesty and respect. Things might actually get better if you taught these illegals honesty and got them to enter legally. Also, teach them respect for our country if you want respect in return. Until you rid the barrel of the few rotten apples, the perception of, and I quote you "Just because they are brown", won't change.

Having worked in the food service and restaurant business for longer than I care to remember (about 40 years) I can answer the question about what these employees are required to do. The average grocery store or restaurant demands nothing...absolutely nothing. Every establishment must have food handling and safety measures in place and implemented. The Health Dept. inspects every business on a regular basis and almost never leaves without writing something up because, as I was told by an inspector, 'No one can get 100%, because no one is 100% cxompliant. The Health Dept is then required to return within a reasonable amount of time to make sure these violations have been corrected; if they haven't anything from fines to being closed down can happen, depending on the severity of the offense. Any consumer has the right to call and complain to the dept and they are obligated to check out the alleged complaint. Also there are certifications out there for busineses and individuals that require classes and tests. These can be a little pricey but give the participant the right to show these credentials. (the most recognised is 'ServSafe') Some businesses demand them as a requirement of employment. I do not know what the rules/regs are for health workers/hospital employees etc. but would imagine they are a little more stringent.
