Illinois consumers again file complaint against Prairie State Coal Plant

The residents of an Illinois town are angry about higher electric bills and sales taxes stemming from contracts for power generated by the coal-fired Prairie State Energy Campus are suing again in federal district court after the first suit was rejected.
The lawsuit, filed October 23, 2015 alleges that Prairie State co-owner Indiana Municipal Power Agency and its consultants misled the city of Batavia, Ill., into agreeing to a long term power contract with Prairie State that has now locked the city into electricity rates that were at one point more than double what was initially advertised. Batavia raised its sales tax from 7.5% to 8% to cover the higher costs. The suit is an amended version of a complaint brought by several residents of Batavia in August 2014. It contains some new claims, like an accusation in the pitch to the city about Prairie State the consultants left out details about problems the plant could face., such as the poor quality of the "high sulfur, high ash, unwashed coal" "that would lead to shutdowns and reduced operational efficiency" the complaint said.
In August, a judge for the U.S. District Court for the Northern District of Illinois, Eastern Division, threw out the original lawsuit, saying that while the deal with Prairie State did appear to be "ill-advised," there was no legal basis for the citizens to claim themselves as victims. considering that the city government, and not the residents, who agreed to the deal.
The 1,628-MW Prairie State plant, one of the last conventional coal-fired plants built in the U.S. experienced a budget overrun of about $2 billion as it was built from 2007-2013. Batavia put $240 million towards the construction of Prairie State, according to a Sept. 22 report from the Chicago Daily Herald.
Another lawsuit against Prairie State could be in the works. In 2014 Batavia City Council asked the Illinois Attorney General's Office to investigate the contracts. More recently, the council has looked at retaining Michael Childress, the same attorney who is representing the Batavia citizens in their suit although Childress noted in an e-mail that he has not been officially hired yet.
The council is trying to determine the best course of legal action, which could include trying to end the contract with Prairie State early, according to council member Martin Callahan. "I think everything is up for discussion at this point." Callahan said in an interview.
Batavia buys power from Prairie State through the Northern Illinois Municipal Power Agency another Prairie State co-owner, and many other municipalities across the Midwest have signed contracts with the plant through agencies like American Municipal Power Inc. AMP is the largest owner of Prairie State with 23.25% share, according to SNI Energy data.
Now I don't know if this is proactive or reactive but it is doing something. Does anyone believe our present council would even make a phone call? I guess it's more important to do carriage rides and trips to Europe to care about this mess? Little by little this town is slipping into the
abyss and this blog. will serve as a record of events.
Now I know the present council members are some real nice people and many of you are happy with them. Would it be to much to ask of them to be a little more inspired when it came to their council positions? God knows they don't listen to me about anything and I understand why but maybe some you could influence them a little?

Expecting to have this Council do anything that might ask questions or raise issues would be like looking for teeth in a chicken.
It won't happen.
Unless I have counted incorrectly, at the start of the new year, there will be just one Council member who was serving us when this mess came to be.
That will mean that 6 members of Council will have been elected since then.
Is it too much to ask for them to start looking into this problem and see if a way can be found to get out from under such an awful contract??
I realize our Law Director must have been involved in the contract but if this is the best he could do, why is he still the Law Director?? In the real world, he would have been gone long ago. There is no excuse for such a contract.
Maybe the reason is that he is bending the ear of Council and letting them know what a great deal it is/was?
Maybe he is afraid to admit that he did a lousy job?
Maybe he is afraid of taking the issue to Court?
Who knows?
Bottom line is that we continue to pay for what was a bad deal then and is worse now.
At least a Council somewhere has the zeal to take the task on.
In the mean time we get a Council that can't decide what a family is or how many chickens should be allowed in a yard.

I wrote a comment a few weeks ago about how this city votes for council people. Now, the day before election day, after almost 40 years in this city I know a lot of people and who lives in many of the houses. As I drive around the city we are once again doomed to a lousy council because looking at signs you can tell people once again are voting along gender, race, background lines, nothing to do with who knows what they are doing.
Whats with the 3 large landlords all behind Werner? Maybe they are afraid she has inherited the extreme liberal viewpoints of her mother? Why are you supporting Aston, she couldn't even bother to fill out the News Herald questionaire so we knew what she stands for? Mirbel?, those signs are in front of every black persons home that I know, I guess everyone thinks he is the next coming of Dr. King?

Term is 100% correct about the time spent debating the "chicken law".
It has been a while but it was something like 4 chickens in 6 square feet or 6 chickens in 4 square feet.
Regardless of the wording, it was a complete waste of time as there was only one residence at issue here.

Term 2:09. Your comment to 3:30 (you tagged them as 2:30) is completely off-base. 3:30's comment was about people voting for someone for apparently the wrong reasons. I believe their comment about the black homes is that every black home they knew had a sign for the black person. It was an observation about how people vote and just how shallow their vote can be, if all the blacks are voting for the black person just because they are black. That is also not the only observation they made about the way it appeared that people were voting. So your comment making it sound like they were saying that black people shouldn't be on the ballot was ridiculous, incorrect, unwarranted and uncalled for. That's the kind of knee-jerk reaction that has this country right in the middle of stupid. And nothing like trying to perpetuate the myth that black people are doing poorly because of white people's prejudice against them, and not because of what they are doing themselves. I mean, look at you; you took a statement that had nothing to do with that and turned it into a totally prejudiced, racial statement. We don't need any more of that crap. You previously took a statement that someone made that said whatever blacks continue to refuse to join America and do well here, then maybe they would be better off trying to find out where their ancestors were from and go there, as maybe that country would suit them better and maybe they would want to join THAT country and do well there. Oh c,mon lay off the chickens..... I have them and I'm glad I have them. They are quiet, as no roosters are allowed, they eat every gross bug in the neighborhood, my neighbors love them and love the eggs(I share) They make great fertilizer, very high in nitrogen, great for the compost pile. I don't need to eat crappy eggs from the store from battery raised chickens and I have taken responsibility for my food source. I also turned my kids old wooden swing set, which would have ended up in the landfill into the chicken chalet. And yes I do that radical thing called gardening.
They don't need a walk, they put themselves to bed, they don't whine or attack the neighbor kids and they don't need a muzzle! They also kick up all the mice in the yards for the neighbors cat. They,re pets with benefits....... And could be the gateway animal to horses. 😀
Not sure why council needed beat a dead chicken over the issue ...... It's really pretty simple.
Also on the chickens...... They are allowed in Cleveland, Lakewood, Euclid etc. Blue Pike Farm at the corner of Prospect and E40th in Cleveland had 80+ chickens the last time I was there. He has now retired but he supplied the whole neighborhood with eggs! Also check out the guys at www.greennghetto.org. The guys are fantastic and started with chickens! It's in the Cleveland Kinsman neighborhood, turned the hood around and the crime rate dropped significantly! Good things from chickens and gardens!

First how many votes do you think a Black candidate gets from someone with a Confederate flag in the yard, a confederate bumper sticker or decal wearing a confederate T-shirt? They probably would vote against their own best interest? The main reason you see signs in yards is that that person knows the candidate it has nothing to do with race. We are diverse but not quite that diverse presently. The key is to find out if that candidate cares about the people they represent equally. You vote for the best candidate.
Now I guess I will hear all about the Historical reasons for the Confederate flag so go on. Nothing to do with enslaving Black people for hundreds of years. Talk to some older Blacks that moved north during the 50's But don't you think my response has merit?

Ok just back from voting and there are two young women dancing with a chihuahua wearing Hal Werner tee shirts. Wonder if they will come to council. Surprised he is allowing chihuahuas to man the polls for him, aren't they from Mexico, guess it's easy for them to get under or through the fence. Loved the guy in the lawn chair next to the Katie signs, we can call him Mr Happy, yup a real ray of sunshine. We are doomed..... But alas I did vote, I was the only one in whole place except the workers. They said it had been very slow. And I loved the woman who escorted me to the ballot and said, I'm not gonna tell ya who to vote for, just vote and do the Christian thing. What?! Really? What happened to separation of church and state? Then again if you live in Painesville you better start or keep praying.

I embrace the Confederate flag and I voted for Obama. Why should I support that flag? It's a freedom of choice, expression, speech whatever it is wherever it is displayed. If anyone can hang a gay pride, pro abortion, etc. then why cant someone from fly their flag of choice without being called racist? It's a freedom to do so. Its a freedom to burn the American flag (I do not agree with burning our flag) but everyone is up in arms about flying the stars & bars? Makes no sense to me.
