"EVEN THE LOSERS" tom petty & the heartbreakers

As some of you are already aware I'm not a big fan of city employee's along with not thinking much of the city administration. This is the perfect storm for me.

With all the hubbub of the city manager's resignation  I completely forgot about the Painesville Service Department employee that was ceremonial fired by the leadership of department heads and acting city manager Doug Lewis. Rest assuredly  he didn't receive a $171,000.00 good-by package.

So knowing the administration wouldn't discuss this with me (in litigation).along with the fired employee told not to speak to anyone it left me to find out some facts on the case from people close to the situation without using their names or positions.

First question is he going to fight the discharge? Yes he is. All this the first step is an arbitration  board
now I am not aware of what kind of setup the city and their unions have but I might guess three from management and three from labor.

What I have learned? The city already has three strikes against them?

It will be asked and answered was this dumping material behind the power plant practiced in the past? The city could admit to it as well as a city employee telling the arbitrators it was.
Had the crew finished the jobs assigned to them that day? Had anyone been reprimanded for overtime violation for say dumping extra asphalt on say Lynch Ave.?   Strike ONE!

Was the employee fired a union steward? Unions hold a special spot in their heart's for unpaid union representation. Believe me it's a thankless job and puts you in uncomfortable situations, along with the thought of management if we can so easily get rid of him. Youall better get with the program. This fact will be important to all arbitrator's. There are times either side needs help, this one is easy.
Strike TWO!

Now I've been told this fired employee has worked for the city for 27 years? It took you people 27 years to figure out you want to fire him?
Strike THREE!

Was any thief involved? any Immoral issue? just two wheel barrel loads of asphalt?

Now the executive director lives in Warren, Ohio and is provided a city vehicle because he's on call? On call two hours away? The other director lives in Mayfield Hts. and also receives a city vehicle for the same reason. Hope the fill out the correct boxes on their W-2 forms? Can we say special treatment?

What if the employee wins/? ATM Ain't Their Money! a public company would not enter into a situation like this , to easy to lose and the company bottom line might suffer.

This service department seems to have an abnormal amount of problems two recently hired city mechanics quit to work for other municipalities? How's that brine salting project going to work better this year? FYI that street sweeper causes more dirt than it picks up. Only three employee's can operate Vactor? Seems like another violation of union contract?

One director estimated a new water line and crib into Lake Erie at 10 million dollars? Now 14.9 million what was he using to estimate? Question; should he be reprimanded?

I hope this employee gets every dime he can out of the city. Harsh? Well after all this employee is going through he filed for unemployment benefits, In true Painesville fashion Painesville denied his claim?  That takes the cake.

Is it me or does the City seem somewhat Bi-Polar on treating employee's

If the facts in this case are the way they are both parties should agree to reinstatement. Along with putting all this behind them. But that's just me.

I'd like to here the thought of resident's.


I was thinking to myself "wondered how long before Obamacare got blamed for the EpiPen fiasco? Yesterday FOXNEWS answered that question. It isn't the middlemen, greed of Mylan no it's Obamacare..... How can I verify this?

No what you do is check what a single pay socialized system like Canada. Well those commies have limited the price to Chinooks to $120.00 no $600.00 oh, and Mylan doesn't sell it in Canada Pfizer is licensed to sell it there?

not a big fan of unions. But the sentence does not fit the crime. Not even unemployment benefits, unbelievable.

Too bad Mr Carson has left the building, he was always in favour of the union employees. He stood behind them but would not back his department administrators. He was notorious for allowing union personnel to his office with an open door policy to RAT out department administration with over exaggeration and lies. Heck he even gave them anything and everything they asked for and kicked his right hand people to the curb.

Just like it appears contempt by administration just breeds contempt from employee's.

Mr Carson had the most contempt in city hall.
Obviously you never had a chain of command or followed it where you worked. Be like a McDonalds employee going straight to Mr. Kroc or a Disney employee running to Walt everytime something went wrong. I know these people are no longer with us but you get my point. Employees go to the next higher up not to the top of the food chain. Those that did should have been dismissed by Carson and told to do it the right way. Some took a fast track to sympathy with lies straight to him and he would not hear the others side of the story. Guilty and gone. That is NOT the way to run a city or a business.

12:22 I've dealt with many chains of command. Some excellent and some like a chain of fools.
BP just changed corporate policy that anyone working on an oil rig can shut it down. The largest oil spill in the Gulf of Mexico as well as lives lost because of a chain of command. chain of command?
Disney as well as McDonalds are not good examples for a small city.

Only the City Manager can hire or fire. I predict that this employee will be reinstated. Contract language was not followed. The Arbitrator will rule in the employee's favor. Doug Lewis is a nice guy but he is in over his head. Les Nero, Rita McMahon or even Tony Carson would never have followed this path. Wake up Joe Gurley this will be an expensive embarrassment. Council needs to hire a real CM. Doug ran into similar problems in Conneaut. We have serious problems in this City and they decide to make an example of this guy. Give me a break!

There was a chain of command where I worked but the question is, who does one go to if their immediate boss IS the problem? In a city like this, there aren't many options.

Furthermore, this begs the question, was there a problem or concern? If there is/was a problem, what difference does it make in who an employee goes to or to who solves the problem? IOW, if the department director can't/won't address it, what is wrong with going over their head?

I can understand the employee wanting his job back ASAP. Now if an arbitrator decides and tells the city to take the employee back without a financial solution to time he lost the city wins! And it will be next man up. Somehow these kid games have to end. I would never tell that employee to hold out for a cash settlement he has a family to feed. But then those administrators know that!

I can not see as you have noted for several years now how the city can continue to maintain the staff levels it does possess. Specifically when the revenue from property taxes has fallen (remember your post about Lusard Street housing prices?) and W-2's have dropped to what... almost zero. Pensioners and Public Welfare and county workers propping up all those nice shining red service trucks. The city should consider shared services and externalizing the costs to contracts (bid for lowest price). You need to have John Cougar's song.. 'Come Tumblin' Down' for the next several post.. as the parking garage gets disassembled.

8:51 The city must have the numbers for the safety force police and fire. I have noticed they don't hire to many new replacement worker's? They are going small thorough attrition, What will the city do/ Well other communities such as Cleveland Hts. South Euclid no longer have reciprocity agreements. Meaning if say you live in Cleveland Hts. and work in Willoughby you pay 2% income tax in Cleveland Hts. as well as 2% Willoughby. I see this coming down the pike for many Lake County communities. As well as being fought by the resident's. The city government never has enough money, ask them.
These city governments for some reason still believe we are living in the 1950's.

5:52 PM Stop, think about the time frame. Do you think the minute Carson left Lewis took it upon himself to fire the employee? No, the termination was more than likely in progress with Mr Carson leaving Mr Lewis to do his dirty work. And since Mr. Lewis is the acting city manager, what is the problem? Why wouldn't he be the person to do this along with all the other duties as CM?

Has anyone come up with a figure for the new city building on Stors St? What was the estimated cost for this project? How much over budget is it now? And how much over budget will it be when finished? Another of Carson/Zovko follies?

2:43 Service garage on Storrs St. is needed the city has dragged this along for over 20 years. Seems something's were forgotten by others? No new service garage but a new unused battery building? Let's talk follies.
2:41 That's unknown but I view it as somewhat odd a person would follow a person that just received $171,000 to leave. Now it does make sense! The wise move might have been to let the new CM deal with it. Since in all probability they will have to anyway.

I like to think I side with what's right and wrong. This was wrong. 27 years and to be treated this way? Now I an sure in 27 years this employee might have had issues with superiors. But did he do his job? And if not why was he in charge of that crew? Look this was an unjust firing and hopefully it can be resolved. I believe he is three years from a pension? Odd we have double dippers and this guy can't get a dip? What if a court rules three years of salary as well as pension contributions?

There are 7 supervisors working at the Electric Plant. 4 supervisors (57%) are double dipping.

We are not allowed to move Electric [or any Utility] money from one account to another by Ohio State Law. Personnel that's a grey area.
