This is the letter I composed to all on council, the acting city manager and the law director.

An open letter to:

Painesville City Council

Painesville Administration

Painesville Law Director

 

The intent of this letter under the Freedom of Information Act is to better understand the reasoning for former City Manager Anthony Carson's resignation from his position. His reception of $171,541.91 (as an ending payment that included six months of salary, over $42,000 in vacation pay and over $62,000 in sickpay) makes one take pause. Now, in viewing the Painesville City Charter, I cannot see where this type of compensation is due to an employee that 'resigns', which then begs the question "...was this a resignation?". I believe city council has an obligation to the Painesville taxpayers exactly how the council arrived at these numbers.  Where and how did our city fathers and mothers come to this decision on Mr. Carson's farewell payment?

I sometimes believe this council freely appropriates money from the city general fund to do with as they wish. Our city is guided by a Charter and the perception seems to be that we only go to it when it is convenient for council.

Whether it's an extra $1,400 a month for the Senior Center or increasing the city's obligation to the DPO to now a total of $28,000 - where is the oversight of the monies sent to these independent groups?

Now what I am requesting is all the contracts dealing with Mr. Carson from his starting date in July 2013 to the contract in effect when he resigned from the city. Please include all addendums as well as other payments such as annuities, ongoing education reimbursements, cell phone, vehicle expense, travel, paid professional license/association fees, life insurances or any other compensation negotiated and paid by the city.

The reason for this information is for a deeper understanding on my part of the process by which the city makes these decisions.

Wait till ya see his city manager convention trips, professional travel meetings, etc. He persuaded people to allow him to go all the while perhaps he was job hunting along the way? Yet he was the very same person to deny others to have professional development and schooling away due to budget constraints? What a Gem!

No way to know for sure but I was told today that Council allowed him to write his own contract.
If true, that explains the nice parting gift.

Did they ever vote to make this payment? When and where?

5:13 That is absolutely the most ridiculous idea yet! But thinking about it makes the most sense! What other reason works? If this is true there should be many more 'resignations' coming forward. From council member's.

5:18 Good question they do not want you or I to know what and how the vote went down.

On a earlier post, someone said that if Council doesn't tell us why they let Carson go it would only fuel speculation and rumor.
Well, I heard a good one today. In an effort to make the Code Enforcement Department more responsive to the needs of the citizens, Mr. Carson brought in Chief Building Official Zofko from Youngstown. Zofko and his Department Head Doug Lewis had professional differences. Lewis was annoyed that Zofko wouldn't do as he was told and Zofko claimed he couldn't fulfill those request because they weren't compliant with State Code. Zofko turned his resignation. Carson refused to accept Zofko's resignation. Then Carson was moving to remove Doug Lewis when Council stepped in. As a result, Zofko, Carson are gone and Lewis is Acting City Manager. Oh, by the way, Code Enforcement Department is still a mess. The City of Painesville has hired a private outside contractor to do Electrical Inspections. Of course, there is no way of knowing if this is true because Council ain't talkin.

6:40 Interesting and last time I looked that garage on High St. was still there?
Code enforcement? Maybe Carson should have just stuck to sidewalks? That subject seems to hold council spellbound.

I just talked to a resident of Berea and learned Berea has completely outsourced all building inspections to private contractors. He is putting on a large addition to his home and loved the new inspectors. They were fair and on time. He said it was the best interaction with the city he has had when it came to building codes. Maybe it's time for Painesville to look into doing the same and get the politics out of the building dept. and code enforcements!

7:54 Maybe if I had faith in the leaders of Painesville? Would council let these people write their own contracts? No presently even though I am a big fan of outsourcing this is not the time or place.
Painesville's main problem is the people charge think more highly of themselves than they should. They love the control.

Enforcement. Saw the perennial yard sale at Liberty and Walnut this weekend. I'm told we are allowed 3 per year. Is that true? Maybe this is the first official one of three?? It was so nice to NOT see the one at Walnut and State Street.

ENFORCEMENT I saw it also. Hopefully it was a clearance sale as the junk stored all up in the front porch is a major eyesore too. Everything must go!!

Has anyone done the math? What is the difference between what Mr Carson received as his buyout to what he would have received if he were just 'let go'. As mentioned before Ohio is an at will state - no reason needed to let one go. Since things have been going so poorly since he began, one would think it cheaper to just can him.

5:07/12:07 Maybe their waiting for you two to buy the whole mess? I don't know how an ordinance only letting you have three yard sales a year would be viewed legally? I don't think anything gets bought it all looks the same.

12:12 I'd like to see the math. The man had a contract and I assume everything was spelled out in it. I disagree things were going poorly. I have spoken to many resident's who believed thing had improved. (not employee's)

Maybe so. Here is the scoop. It's 4 sales per year.

Section 735.10 - There shall be no fee for the registration of garage, yard or porch sales conducted on residential property. However, such activities shall be limited to no longer than three (3) consecutive days and not issued on the same individual or for a sale on the same parcel for more than four (4) times in a calendar year.

And no indoor furniture on a porch, no unlicensed vehicles parked on properties, no building without a permit, trash out after a said time and cans retrieved at said time. Who listens to these rules because nobody will enforce them here.

The other place that always seems to have a sale going on is the NE corner of S State St and Walnut St.
They are constantly bringing things back to the house that people have thrown away.
I always wondered where the stuff lives when there is no sale going on.
Well, three days ago I think I found out.
The front door and the screen door were open so you could see inside a bit.
It looked like an episode of "Hoarders'.
Stuff piled as high as was possible. I always wondered why their windows were completely covered and now I know.

That's a shame. Both those houses at that corner were so beautiful at one time. We had our Girl Scout meetings at the house second from the corner and knew the family in the corner house. Such old character and house pride are now gone.
