When this whole ordinance was written it was simply to get homeowners and banks to cut the grass? Now it has turned into a money maker and revenue source for the city. That was never the purpose. The Mafia could learn something here. A well known city resident told a story of his son purchasing a home in Painesville for $26,000 and even after a title search the city put a "hold" on his utilities due to vacant property fines and fees that totaled $9,000 going back to 2011! First off we should be upset that homes can cost only $26,000 in town, but here is a father guiding his son on his first purchase, and he should have guided him out of town ... well it's Painesville. Councilman DeLeone suggested he negotiate? Yeah sure.
Landlords are now expected to report who is living in their rental properties even including social-security numbers as so the city will receive all income taxes due them. Law Director Gurley suggested when a tenant has utilities turned on the city should have all necessary information ? Look if your going to ask them to fill out a form maybe we all should? Naming all parties 18 and over living in the house and asking where they work . I guess it's now time for us to turn in fellow residents? My best take, go find out on your own. That's what and why you pay RITA the 3% for.
The budget, forget the budget. doesn't really tell you much. As you drive downtown please view the new Christmas decorations. First let me thank PCIC for the $10,000 donation for the cause. Now let me explain $13,000 came from our electric fund? We can't repair a vehicle, fill a chuckhole, pay a policeman ect. but we can by electrical Christmas decorations. Now during the visitor time I suggested that the city annex all of Painesville and just keep that piece of Heaven known as Downtown. Hell, we spend every spare dime down there seems the rest of the city is just an afterthought. I suggested if the city had electric money to burn maybe they buy a couple of cases of efficient energy bulbs. and if a resident turns in a burned out bulb give them the replacement free. Saves the resident money as well as lowering energy consumption. Nah, Christmas lights! Forget the budget? Nowhere in the 2015 budget did I see purchase Christmas decorations. So s#*t happens! On a positive note I did congratulate council on getting rid of all the "Others" in the past few budgets, that drove me nuts. Other what?
The continuing saga known as Painesville Power. Mr. McHugh reported on the outage and breaker box situation that occurred at Heisley Park. Well we're sticking to the squirrel story along with some mumble jumble about an electrical "Wave". Now City Manager Carson explained yes he had to replace his breaker box ( at his own expense) Councilman Deleone assured not only Heisley Park but Liberty Greens home owner's that all electrical items were properly installed and inspected. Well, Mr. McHugh just couldn't explain why an apartment building built in the 60's closer to Heisley Park the breakers there only tripped? Your going to love this answer! "Well I guess they don't make them like they use too!" Sleep well HP residents! That incident never should have taken place.

I know for the most part it's all politics but candidate Mike Huckabee his analogy was if you had a jar of 1000 pieces of candy and you knew 10 may be poisonous would you let you child eat the candy? Right now is not the time to welcome refugee's into this country!

I can't speak for anyone else but my SS card says very clearly "Not to be used for identification" on it.
That would mean that a landlord can not ask his/her tenant for their SS number for any reason at all.
Furthermore, if the City wants to be sure they get any revenue they feel is owed it is their job to chase it, not mine.
As long as I pay my taxes, I really don't care if someone else does or does not. That is not my concern.
Don't overspend and it is less of an issue.
Then why does everyone in the world want a SSN? You cant make a doctor appointment without giving it, ETC.
I agree with you 12:05. We have had a couple of hacks on our atm cards I'm sure its only time before somebody that has my SSN will be hacked and we'll be hosed.
OH, but how many of these fine upstanding illegal immigrants have a SSN? Just how will that work for them to obtain a rental house? Metricula card? Will they leave or will this just allow many more to live under the same roof?
I think the news services, like Channel 5 News, etc., ought to be made aware of that 9,000.00 charge and the whole situation. Not only should all of this be illegal, but they should be exposed for what they do to the citizens here. Let's just get that on the news and see if the "see if you can negotiate this" statement stands. Unbelievable. There is literally no reason to live in this city anymore, and so many reasons not to. Someone needs to expose this...and all the reasons behind it. And now they want tenants SOCIAL SECURITY NUMBERS???!!!! We need to put a stop to this. See if you can negotiate this, my a$$.
12:58: In case this helps you or anyone else. I don't give my SS number anymore at the dentist office, etc. If they don't need it for billing purposes, as in a Medicare number, which is unfortunately your SS number, then don't put it on there. If I am asked by the doctor's office, or wherever I am, or if I cannot continue on the check-in screen without giving it, I ask for assistance, and I just tell them I don't want to give my number. I have never had anyone fight me on it. It is a habit for these places to ask; it is none of their business, and 12:05 is correct in that it was never supposed to be used for identification purposes. Just leave it blank. And it is certainly not any business of Painesville City to be asking for tenant's SS numbers. These people and this city are completely out of control.
As per the original post...maybe now people are beginning to see some of the serious issues of having illegal people in the country (and, yes, refugees, too), and especially the illegals we have here from probably every country in the world. And Obama has been purposefully letting them in, as in all the families that have been storming our borders for the last few years. We don't hear anymore about it, but they are still coming. Obama buses them into different parts of the interior of the country, and makes the cities/towns deal with them. Now he has stations set up in different countries so people can apply right in their countries to come instead of making the dangerous trip. They will probably be flown here at our expense, and they and their families will be on welfare roles for many decades to come. We need to know who is here. We need to have control of our borders, and we need to get every illegal out. How in the world are the police supposed to keep up when the federal government is letting our country be completely overrun by people here illegally. It's insane. Maybe people are beginning to understand what the fight has been all about, and maybe people will join the fight now instead of fighting the people who are fighting. As for the "they're just nice people here to make some money for their families" line, we have legal migrant worker programs for that. They can sign up and get in line. And before any bleeding hearts start...it is an optional program, meaning anyone who does not want to come here and work here under those circumstances just simply should not sign up to come. One of the problems they have with the Muslim community in France, and so one would assume wherever there is a Muslim population, is false I.D.'s. Sound familiar?
It is unfortunate that a home buyer might be held responsible for past due fees and utility costs remaining from the previous owner, but this practice is commonplace throughout the country. In real estate terms, it's called Caveat Emptor, translation Buyer Beware. It is the duty of the buyer to do their research before they buy; ignorance is not an excuse. It helps if they are using the services of a Realtor as we try to stay current with the various changes in the communities we service, but ultimately the burden falls on the buyer.
The following document is a NEWS RELEASE, published 25, 2015 by the City of Painesville. What appears below is somewhat abbreviated due to space constraints.

BUYING OR SELLING A HOME IN PAINESVILE, OH. WHAT YOU SHOULD KNOW BEFORE MAKING THAT MOVE?
With the recent housing collapse, many homes are coming onto the market. This is not only true in Painesville, but communities throughout the United States. This is the result of bank foreclosures and homes that become available through sheriff’s sales. While many of these homes seem like a bargain, many are not. For this reason, the City of Painesville wants to inform potential homebuyers and landlords about the research they should perform prior to purchasing a home in our community.
Prior to purchasing a home in Painesville, the following should be researched to eliminate any issues you may have before taking ownership. You or your Realtor will need to contact the appropriate service providers to determine if there are any outstanding fees or issues with the property. This includes the following:
1) Check for outstanding Vacant Property Registration Fees. If a property is vacant for more than 90 days, past due fees may be owed. It is highly recommended that you inform your Real Estate Agent and Title Company in writing that outstanding vacant property registration fees may be owed and that they should check with the Painesville Community Development Department prior to closing on the property.
2) Determine if the property is Non-Conforming? If a property has been vacant for more than one year, the City of Painesville requires that it be brought up to code and conform to the requirements of the zoning district in which it is located.
3) Check for any outstanding liens on the property. Past due liens owed to the City of Painesville can be checked by contacting the Community Development Department at (440) 392-5931.
4) Check with the Painesville Utilities Billing Department to determine if there are past due utilities owed (water, sewer, and electric). The Utility Billing Department can be reached at (440) 392-5797.
5) Check with Waste Management to determine if any past due fees are owed for refuse collection and recycling. The City of Painesville requires that all residential dwellings three (3) units or less have refuse service through Waste Management. If the property is vacant or the prior owners did not pay for refuse service, there may be outstanding bills.
6) If the property is in poor condition and improvements are needed, it is highly recommended that the potential owner contact the Painesville Building Department at (440) 392-5931. Potential buyers should talk with the Building Official to determine what permits will be required and the estimated costs.
I saw an interesting thing today on CNN. A Muslim woman, apparently of some importance and with some knowledge of Muslims, at first was taking the U.S. to task for not taking in more Muslim refugees. Then she said what really needed to happen was that the other Muslim countries needed to step up and take in some Muslim refugees. When asked, she said that no, other Muslim countries have not historically, and will not now, take in Muslim refugees, because of the safety issues involved with them, and that they are afraid for the safety of their countries. She mentioned specifically Saudi Arabia and Egypt. Yet Obama keeps insisting on letting them in here, and now is saying he will let more and more in. At least it finally looks like some of the world is starting to stop the dangerous political correctness at least on some issues, and it's about time. And who knows how many have come in through our open borders that we don't have any idea that they are even here or who they are. You would have thought that 9/11 would have taught us a few lessons, but apparently it has not.

That sounds great in practice but the reality is very different.
First, why would a first time buyer in Painesville be aware of what you quote? As a matter of fact, why would they even thing of it or look for it?
Is it the job of a realtor? If so, I can state with 100% certainty that it is not done all of the time or even most of the time.
How do I know?
Because, over the last 5 years, there have been many appeals to the appropriate Boards in the City because the real estate folks were more concerned with making the sale and NEVER brought these issues to the attention of the client. You might be different but that is the truth.
Concerning Waste management, that is a whole different issue. Since when is the City in the business of collecting past due bills for private companies?? Do they collect for the gas or phone company? If not (and I know the answer), why not? What is the difference?
If WM wants money that is owed to them, it should be (and I think legally it is) their responsibility.
9:14: Also, there is just a base charge to all properties from Waste Management for service, whether anyone was living in the residence or not. So there can be a Waste Management bill for nothing to the new owners; it doesn't have to be late. But I have heard repeatedly that illegals will rent someplace, run up all the bills, then just walk out and go to another house or apartment. When you look at that list of all the things that a new owner might be unaware of but responsible for, it is outrageous. I am surprised this has not made the news. Anyone knowing this even goes on in Painesville, would be insane to buy a property here. That list is nuts. And they can't figure out why nobody wants to come here.
Ms. Howlett, the seller (owner) of real estate pays a fee when the property is sold. This fee is split 4 ways; to the listing real estate office, listing agent, selling real estate office, selling agent. Therefore, in a real estate transaction which is listed / sold by a real estate office, the realtors are employed by the seller and of duty to the seller. Having said that, there is something called disclosure in every transaction. There's a page for that in closing documents, and the seller has to sign and date. In the case of the $9,000 fees, sounds as though someone didn't honestly disclose. But as a realtor you know all this so I'm surprised by your post.Done all across the country? Ummm - until someone gets taken to court I suppose. It would be kind of difficult for the owner to say they didn't know about these fees they owed.

To 9:14 AM - I don't doubt some Realtors are unaware of Painesville's policies. It's nearly impossible to keep up to date on changes to policy in every community. I do know, though, Painesville did an excellent job of getting the word out to the local Realtor board office, which in turn sent an email blast to every agent member of that board. If certain people didn't read it, shame on them.
To answer your question about whose responsibility it is to research local laws and policies, it is up to the buyer, whether first time or seasoned. I know it doesn't seem fair, but that's the law. Caveat Emptor, a.k.a. Buyer Beware!
I too heard the story about this house and vacant fees. I saw the bill, so I know it is true. If it isn't a filed lien on the property that would show up on the title search, I don't know how in the world a buyer is supposed to know, or even think of it. If the City wants to collect, it should put a lien on the property, so anyone can see it. This is quite the shakedown the City has going. This buyer could end up having to pay more in these fees than the purchase price.
Why would the City discourage someone from buying a vacant house, fixing it up and improving it, thus increasing the tax value? This joke of a City would rather it sit vacant, accruing fees, that someday may or may not get paid. At this rate, the City may end up owning all the real estate as nobody will be able to afford the vacant fees, and the City can foreclose on the property.
Term 9:01: It's very simple; there doesn't need to be any give or get. Just follow the laws of the United States of America. We have the laws. They are there for a reason. Follow them. All illegals out. And while they're at it, they can quit misreading the 14th Amendment. E-Verify.

So if I understand you correctly, the realtor could ignore the disclosure mentioned by 2:22 and it would be the responsibility of the buyer to learn about it?

In the first paragraph you make two statements that, at least to me, seem to be in opposition to one another.

To Kathy Sak: Not all property sales involve a Realtor, i.e. sheriff auctions and for sale by owners. Disclosures are completed by sellers, but when the seller has never lived in the house they are not obligated to complete the disclosure. Examples would be flips or inherited property.
To 4:35 am: A disclosure is only as truthful as the person completing it, and Realtors are not allowed to be involved in the process. As I also mentioned above, in many cases Realtors are not involved in property transactions. For the times they are involved, Painesville City made the attempt to educate local Realtors through the local board office. Emails are not always opened and read; therefore, those agents are certainly not dishonest, just uninformed.
But this all goes back to what I wrote originally... the buyer is 100% responsible to research all aspects of the property they are buying.
This makes absolutely no sense to me on any level. If a city wants to thrive you need to make it enticing to home owners. There is nothing in this city that makes it enticing to want to relocate here! It is NOT like this in other in communities. Check out the Waterloo district in Cleveland. Traditionally artists look at moving into rundown areas because its cheap. Waterloo gave incentives to artists and small business owners to move in, no hidden fees. And most live in the neighborhoods they do business in. Instead an open hand and a bit of funding from several agencies. Read Crain's. Look at Ohio City in the 70's and 80's. Tough neighborhood, yet a few private homeowners put down a stake and eventually the neighborhood turned around and it's now quite the upscale place to live. There were no hidden fees, the city wanted land owners to invest in the property. Compare the tax base in Ohio City during the 80's to the tax base today. Compare the business base in Ohio City during the same period. This has worked in community after community in northeast Ohio. Little Italy, the Detroit Shoreway, Tremont, the artists have taken hold at E40th and Perkins and it's beautiful. My business is located, The Old American Greeting building, we are completely supported by the councilman, Gordon Square Arts District and the landlord. They want us to put the money back into the business, and property.
If indeed it is as real estate agent Howlet has said repeatedly; buyer beware. Who in there right mind would buy a house here? It's not like this in other cities! You hire a real estate agent to work for you but in reality they don't. And yes, it is common knowledge not to buy a house in Painesville. After reading your postings Mrs Howlett I'm not sure you would be on list to call when I do sell my house. I find your posts to this blog quite disturbing. My house is not just for you to make a buck.
I also question a landlord giving a personal SSN to the city. The city pays RITA a hefty sum to collect taxes.
Also if economic development had done their job and kept businesses here with their tax base maybe the city wouldn't be wringing every last dime out landowners. But they did not do their job, nothing came in to replace major companies moving out. Council did not do their job either and now home owners are going to be squeezed like never before.

Mrs. Howlett I believe you do consider yourself a professional. When a person enlists your services I believe the last thing they want to hear is "buyer beware" Caveat Emptor? Look I hope you don't meet prospective clients with that answer? When most people buy a home which many only do a few times in a lifetime they expect people like yourself to look out for them. They don't expect surprises like the surprises sprung on them by the likes of the City of Painesville? That in my eyes are the responsibility of the real estate agent as will as the title company? If it isn't recorded as a lien what is it recorded under? Councilman DeLeone suggests you negotiate? How do you negotiate something you didn't know existed? His solution to Bob the Barber seems to have been to negotiate the property value with the bank? $16,000 for the bank $10,000 for Painesville City? Mike and the rest should get off their dead a##^* and fix this ordinance instead of explaining to people to know something they didn't know. Have heard rumors council has no intention of fixing this mess? Does anybody really expect an inspection to solve these problems? I guess council including your daughter sees no problem with this legislation or she might file a motion to vote on changing this ordinance? She did mention a appeal process or as most things mentioned in council just get dropped? Let council vote on changing the ordinances maybe we will then find out where this bunch stands? I recommend going to the title company and filing a claim against the title insurance, they will probably get a lawyer to fight the city over this nonsence and than see what happens, In my opinion the city waits for homes to transfer ownership than slaps it on your taxes that week to try to slip it in and than deny you utilities unless you pay up. it seems like extortion to me. cant wait to see if they make a bs ordinance like menotr on the lake just made where any business that provides a service in their city has to register every business vehicle they own and have to pay a per vehicle fee, I just wouldnt provide services to their residents in that case
