Picking up today News-Herald 07/01/14 was a front page story about Painesville's Heisley Park. Also featured was a picture of Heisley Park residents that included our Congressman David Joyce. Remember all politics are local. I noticed in the picture tank cars behind the congressman also in the story, it included a video of a train passing by that included a tank train going by Painesville at over 50 mph. Worry all you want about noise and polution. but if something goes wrong those tank cars will take out your neighborhood. What was in those tank cars? Chemicals, corn syrup, maybe ethanol? I understand the noise and polutition  are a problem but whats going past your home every day should have you more concerned. Did the builder as well as the city even bother to check placing homes so close to one CSX most used tracks? Don't believe me ask our Fire Chief..

I guess I question the homeowners the most.  I believe these are $160,000 to $200,000 homes. To afford a home at that cost you must of had many options. Why so close to a busy railroad?

I must admit someone down there has "Juice" a Congressman really? Then again the good congressman  he should know  better the FRA will back CSX 100%. Well the city did get them to donate up to five trees as a match to the city or the homeowners association? Hope there Redwoods I don't see ten trees making much of a difference. Ten tree's problem solved...... let's move on.

Assitant City Manager Doug Lewis had a problem with where the signal was located. It's placed there maybe sixty years ago  because the siding ends a little to the west it was not stationed there to upset neighbors.

City Manager claimed the city can do little, with the exception of enforcing  NOISE ordinances? Well I know a place you could start.

Whoever has the juice down there could you please throw me a bone and have a councilman or city administrator answer my questions?

Let's see $200,000 homes. city manager lives nearby, some in Heisley whine even more than you do. A congressman looking for brownie points must have left wondering whats wrong with these people? As for you council just will ignore U!

Your questions leave a lot to be desired. Don't you think the builder and the city would have all their I s dotted and T s crossed. I'm sure they did all by the book so if you want to point blame, again blame those who bought there without noticing the TRAINS and TRACKS.

Boy am I over this story and it should be headed under the title "buyer beware". Where is the homeowner responsibility in all this. As a resident even I'm siding with CSX. I have seen this on the local news channels, in the papers and talked about endlessly. I'm more outraged by the mess we paid for on Main Street, lost parking spaces and use of an outdated design other cities have used and already reworked. I will look nice but it will not be better for merchants or customers. You just took away quite a bit of parking.

Shouldn't we be putting money toward future energy, enticing new businesses, flooding issues, water lines and paving? Gosh Heisely residents can get to their homes without blowing a tire and bet their water is pretty is clean too in fact I bet they have the newest water lines in Painesville.

All in all somebody should be held accountable for allowing new home construction to be built so close to the tracks. Especially since the last derailment was recorded and hanging in city hall. Anybody remember that? Unfortunately those who pushed this through are long gone. I believe Ryan Homes is still around though.

There are so many places that need attention in this town yet a group of residents who knew what they were buying and signed on for it, get front page coverage...... mystified.

As for Atwells........ doesn't the noise ordinance work there too? Would the owner ever come to the table to hear residents grievances and off a solution? And hopefully it wouldn't be a lynch mob but let's try to figure this out. Atwell's and residents have been there forever. What changed, when and how do fix it?

7:17 The problem surfaced for Atweel's with conceal and carry came about. People wanted to protect themselves but it drove shooting ranges to increase business. Also lately it's seems they are shooting higher caliper weapons that make more noise.
All I'm asking is to see the variance and if it is being followed? All I get is silence from council and the administration. Why? I still get the noise.

Does the city have an obligation to protect people from themselves? Well I believe the city had a responsibility to keep homes away from the tracks and to have a quality buffer. Look what does the newspaper articl say about the quality of life in Painesville?

This story is insane. It is like the people in Painesville Township that bought up there in Lake Erie Bluffs and now complain about the smell of the dump and the industry up there. Didn't you look around before you bought? Why is it now someone else's responsibility to bring the value of your property up?

6:00 I heard about someone moving out to the country and complaining about a farmer spreading manure. Yes this story seems to blame all the wrong entities?

Your problem term is the failure to understand a simple idea.
You get more flies with honey than you do with vinegar.
You show a very small amount of honey to our city leaders.

You know what's frustrating all I want is an explanation and some paperwork I'm not asking for them to remove trains from my sightline.

Hmmmmm I always heard the squeaky wheel gets the oil. Oh well that said this city has more rules and regs. than most. At times there seems to be a double standard, don't think I'll ever understand the Your Vine or Mine Fence issue. Who hangs signs and for what is always interesting too. If you can use rules and ordinances on the books for one, why doesn't it apply to all?
You shouldn't need manure or honey.

TERM, if you feel they should get buffers, then what about all the other houses in town who are living butted up to the tracks? They haven't been complaining but they still have the noise problem. They learn to live with it. But if Heisley gets buffers, then the rest of homes in Painesville near the tracks should get buffers. Period! because their houses are worth more doesn't mean their quality of life is more important than the others.

WHY are you the one asking all the questions and demanding answers? You make a bigger deal of it than the people that live there do. AND you don't even live there. Same with most of the things you bring up. Why do things that are of no concern to you bother you more than the people that deal with the situations?

11:28/12:57 Well because as a resident I can. After the holiday I'll fill you in after the holiday as to what I found out.
The buffers should have been put in before they started on that plat. It's a little late now.

Again, if Heisley Park gets buffers then all houses in Painesville near the tracks should get buffers. They are not any better than the non annexed residents of Painesville.

Maybe Term will pay for buffers around Atwell's to eliminate the sound. Then put one along the RR tracks for the folks that have lived there longer than Atwells has been around. How bout it?
