"COUNCIL MEETING MONDAY 03/02/09

City Council Meeting or also known as the Bartum & Bailey Sideshow by some at city hall. We will have alot of Amending to do, plus splitting up some FEMA money. It will be interesting if any councilperson brings up the accusations brought up in the blog.[over500 hits] going around town. If one does the others sitting at the table will look at that person as if they had lost their mind. The fact is we have no idea if these allegations are true or even if the whole thing is made up, any laws broken, any rules in the employee handbook broken? A council member can ask alot of things but as far as being able to do anything ,not much. The only person at city hall they have control over is the city manager period. I would only think that innocent people would want an investigation to clear their names. That said the only way this will progress if council and the administration feel some heat from the citizens of Painesville. I believe City Hall will be comfortable riding the storm out. Malfeasance or Malarkey?

FYI for all of you regarding city policies within the Employee Handbook.
Information Systems/Computer Usage section.
Sections are long and here is one main statement: "Information systems are the property of the City of Painesville and the use of these devices is a privilege that is subject to revocation (A)."
"The City reserves the right to access for quality control purposes and/or violation of this policy, data, electronic and voice transmissions of employees."
"Employees are advised that they do not maintain any right to privacy in information systems or equipment or its contents, to include personally owned software (if approved)."
C of these procedures reads as follows:
"Accessing or transmitting materials that involve the use of obscene language, images, jokes, sexually explicit materials, or messages that disparage the City, or any person, group, or classification of individuals is prohibited whether or not the recipient has consented to or requested such material." There also is a section in this Handbook regarding such devices as cell phones, pagers, and telephones. If we are sending personal messages within e-mail, don't you think we should track records that pertain to administrative's cell phones, as most department heads are given cell phones. Handbook statement:
"Costs that are associated with excessive and/or personal costs that are not reimbursed by the employee may be considered theft and will result in appropriate corrective action."
In addition to the Employee Handbook, the following is for City Council Elected Officials.
Under the City Charter - Article II Legislative Authority
Section 3: Powers and DUTIES of Council - #6 States the Following:
"Inquire into the Conduct of any Office, Department or Agency of the City and make Investigation as to Municipal affairs." Conduct is the key word here.

All that has been stated is readily available to read. If for some reason any of you cannot find this info, leave a word on the blog and we would be most happy to assist you.
As the Baetzel trist has been confirmed by many many city employees, we do not condone the use of public equipment (paid for by all of us) to continue his internal/external love-life.
Council (through the oath of office) has a number one duty to call for an investigation.
The City Manager is not the one to accomplish this investigation nor is it the county prosecutor. This type of action is delegated to the Attorney General of the State of Ohio as it is an abuse of power and abuse of publically owned equipment, publically paid monies for working hours, and who knows what else regarding his job and office.
The advice for an Attorney General investigation came from many many elected officials and legal council.

Conduct may be a key word but also key is "and" as well as "municipal affairs". Is this a municipal affair or a personal one? Treading on shaky ground here

Just hope everyone reading this site also understands that "if" there is an investigation going on any public official with knowledge or involved can probably not legally comment until the outcome is determined.

Duh!!
We just knew that one or two out there would use the word "affair" in the wrong text.
It is obvious that this section of
"Powers/Duties" was written back in the day with old terms.
New meaning (which is really the old meaning) "Investigate as to what each department is or is not doing according to their defined duties/parameters - are they being productive - are they adhering to the policies of this city." Namely what is written in the Employee Handbook which all of you can read on-line.

FYI - Employee Handbook.
Go to City Depts on Home Page and click on Human Resources. Next Page Shows Handbook & Benefits but it is not underlined (can't access). Click on Public Records. This next page shows Employee Handbook as underlined - click on this. Go towards the bottom of this page and click on the download copy of the Employee Handbook.

As for Council - pull-up the Charter. Go to Article II Legislative Authority.
Section #3 Powers and Duties of Council.
Move down to #6 and read what the Charter states. Be sure to note the date of this charter entry.

Explain/justify your "Shakey ground statement?" When anyone speaks, they best be able to Justify their words.

You took one word out of total context and did not read this Charter amendment nor its date of inception.

If you so choose to continue to make statements, try justifying them with facts and stop trying to be the attorney who manipulates all words to support the actions of one who knows, but will not acknowledge nor speak the truth, that he/she violated the rules of conduct per the City rules and the ORC of the State of Ohio.
Go study all of this so that you will be more educated for the future.

COUNCIL MEETING 03/02/09
Pretty uneventful, except a resident from the northend of town came in and read them the riot act about their, electric bills, street disrepair, and the present form of government in the City of Painesville, I don't think anyone seen that one coming. Everything passed, city's Downtown Master Plan put on first reading.
Randy Bruback gave a report on the Waste Water Treatment Plant, he's the only person that could make that place interesting. Tony told me he likes Randy but can't figure out why he hates the Ford Motor Co. I asked him what he was talking about? He claims all Randy complains about is all the Mercury's that end up in the river.

What was the bigger crime two people having an affair or someone uninvited going into the citys database? What files were accessed? what other employee's files were viewed? How many other people have the password? Just something to think about.

When an attorney, and public servant writes a legal binding contract for employee conduct, and has a reputation for holding the line for ANY infraction - and then blatantly abuses policy, position and power ... right under Rita's nose ... tell me ... I beg you ... what is the criteria for accepting and in fact rewarding this behavior?

I'm a Painesville resident and I couldn't care less what these two lovebirds are up to. And if you're a City employee and you have ANY personal files or pictures on your computer, or you have EVER used your city email account for personal business, you have no right to throw stones. I would be willing to bet that not too many employees anywhere could honestly say they've never used their work computer or work email for "non work" stuff. Give me a break.

Sexual hijinks aside, the moral of the story is, NEVER put anything in email you wouldn't want the whole world to read someday.

CITY MANAGER, RITA MCMAHON, YOU SHOULD BE ASHAMED OF YOURSELF FOR ALLOWING THIS SITUTATION TO CONTINUE AND FESTER LIKE IT HAS. COUNCIL IS A LAUGHING STOCK. AT LEAST INVESTIGATE THE SITUTATION AND GET TO THE BOTTTOM OF IT. ETHEL

An investigation will prove the truth about a public servant in position of power - exploiting a subordinate and engaging in sexual misconduct, at the very least ... Lynn should smarten up and find a killer attorney.

Why do you think an employee handbook is written and published on Painesville's website?

So it can be used by Bob & Rita when it suits their agenda?
