At the last council meeting I asked for and was sent our Waste Management contract (2011-2015). This was a three year contract with options for a fourth and fifth year.

Well the contract I received was pretty much left blank in the amount department. I did find something very interesting in the Addendum's on the contract.

First the city did agree to act as a collection agency for Waste Management  according to Painesville Ordinance, number not given. (still don't see this as legal) Some collection agency they turn out to be they turn Waste Management's amount to the County as a lien on that address.

What I really found disturbing with the Addendum's was ;

5) ANNUAL FEE  Contractor shall pay the city Forty-Eight Thousand dollars ($48,000) annually for each year of the agreement extension. The first year payment ($48,000) shall be due on or before December 20, 2014. The second payment of $48,000 shall be due on or before December 20, 2015.

Total of $96,000 for what?  Want to take a wild guess who's pocket this $96,000 is coming from? Why? I thought the city looked out for us not themselves or Waste Management.

Another interesting thought what fund does this $48,000 per year go to? Justification?

Maybe council should do their job and our  refuse bills would be less expensive?

This is one sweetheart deal that doesn't even give you a kiss.

Wonder if WM has made cozy deals like this elsewhere?

This is 1:09 from the previous post.
This is pretty much the exact point I was making.
There is no free lunch, that $48K comes from somewhere and that somewhere is us.
By definition that means we are paying more than we should for garbage collection because Waste Management doesn't give up that kind of money as a "gift". Besides, it was agreed to, by both sides, in writing.
This raises a question or three.
Where does that money go and how is it used?
Is it now part of the City budget?
If it has become part of the City budget, why?
After all, with a contractor change, that money could go away never to be seen again.
Or, more likely, the City will use it's leverage to extort more "hidden" fees from the next refuge hauler.
Look, garbage collection is necessary. No problem with that. However, IMO, this should not be a profit making enterprise for the City. Even if they were doing the work, it should more or less break even. With the City farming it out, there is no way the bills should be forcing us, as customers, to pay $48K back into our own City.
It is a hidden tax, pure and simple.
Looks like we will have one more year of this little deal from the former CM. I really hope Council has their feet held to the fire when the current contract ends. We don't need any more hidden taxes.

we need to clean house of council members and make all these hidden taxes go away or keep getting rid of them untill it does

6:06 The former CM signed the agreement 3 years with a 2 year option but she didn't sign the addendum. Which raises many more questions.
First who on council was aware of this? Is it legal? Is it ethical?
Your right this money was not a gift well maybe it was but you and I paid for it.
We must watch if council does the right thing and takes some of these negotiations back.... Best guess they won't.

The city has made so many horrible million-dollar deals over the last many years (and aren't they continuing to make such horrible deals?), that they are gouging us in every conceivable way they can think of to hide it. (And speaking of horrible deals, lets not forget former City Council member, Joe Hada, who voted "proudly" when he voted to get us into being part owners of a 40-year (?) coal plant!) In my opinion, this city council, and this city manager are just as incompetent and slimy as the last bunch.

There doesn't seem to much outrage concerning this $96,000 gift, that's sad. If hey pull this off what's next. The people here I guess deserve what's coming next.
Rumor on the street seems to be your thinking about running for council in either ward 1 or 3 any truth to this?

10:16 Not a chance. I like to watch the train wreck not be a part of it. First Ward I is in good shape.
Two people have shown interest in
Ward II plus the current member.
I expect three people to run in Ward IV (possible another from Heisley Park)
Ward III I hear a lot of complaints but no one to challenge. Which is sad in the last over 8 years that ward has had very little input from council. First Mr. Fountain was ill and God only knows what Mr. Deleone's plans are, he want's to be your council representative until the current Muni Judge decides to retire, then see how bad he wants to be your councilman? Another looking for a stepping stone. Since our JR.ADA has been representing the ward gambling machines have been put into establishments, a Head Shop has opened, along with what appears to be a junkyard behind Lina's. Residents just have to look at Cedarbrook There's a 100 ft. of terrible street by Monroe will it ever be repaired correctly? Plus the fact a water line needed repair near Lucille and that was to be kind a half-assed street repair. A little further down the city installed a new water line on East Ct. and the area heaved on Cedarbrook. The city's remedy was to put a big orange sign that said BUMP really? When I had my question about the gun range my attorney spoke with the councilman and allegedly the councilman claimed I was getting old and didn't remember to much. My attorney just happened to be my son-in-law. So I guess I'm just to old but to go to council meeting and watch the circus. Mike does a nice job wishing his wife Happy Birthday on the council video and showing us his lawyering? This Ward needs representation, period!

Why isn't it their money? You continually say this but they LIVE here too. It's just as much their money as it is yours or mine. They have an interest in the money just as we do.

The new WM contract gives single family homes two large totes as part of the deal for the increase in price. Only a small percentage of the families actually use them. It appears the city gave WM a real deal on this. Historically, sweatheart deals like this do not go unrewarded by the cartage industry.

2:36 You make a valid point seems all this turmoil started when the two year option did? Seems odd that the city could put a lien on your property without a vote from council? Is this procedure what is known as a kickback?

So you'd rather sit and watch the train wreck than avoid it? Typical. Your avoidance to gloss over the streetscape trouble and ramble about the trash says it all. So, according to you it's okay for the city manager to FIRE the company, lose 200,000.00 dollars, the grant that was paying for it and any future grants? That makes no sense. Something needs to be done about this man, soon. But as usual council doesn't have the spine to do it. He can walk all over them, tell them no, what to do and they still keep him? He is not an administrator, he refuses to back his staff and would rather be a union buddy instead of an administrator that needs to do the job he was fired for. Who else gets to tell their boss "NO" and still keep their job? He's not only ruined this town in a short time, he has ruined the several hundred employees that are employed by the city too. Council Do Your JOB -that's why we voted you in - and can vote you out.

Oh, I forgot. Since this place is broke and the roads are like a war zone. What's with the piece of broken down trash of a police car in the lot by Arby's? Are we that poor & can't fix a flat? If that car sat on a residents lot, how fast would they get a ticket? Why is it not good for a resident but good for the cops? This isn't the first car I've seen. A while back there were 3 - just taking up a parking space for a resident doing city business. Again, cops are above the law?

12:03 That train has left the station. To old and although the present council on the whole are pretty nice people they seem to be lousy city council people. I if you read this couldn't get elected to well anything. I don't fit the mold.
I have complained about "streetscape since it's inception as a total waste of 1.3 million dollars. In all honesty the contractor should have been fired. I have seen no proof that the city lost a dime of that grant let alone $200,000? I do believe that there should have been a public hearing before they were let go.
Ramble about $96,000 is a lot of trash.
I believe there is more to the story then a simple NO, clue us in?
Hard to tell how much he ruined the city? Pretty much was a train wreck when he got here. I do agree council should do there job!
Police car with flat tire? Probably from traveling our roads,. Maybe an electric plant worker can change that tire?

I don't really need to speak for Term but, if you are going to quote him do it accurately.
This is NOT what he said. He said he would rather watch a train wreck rather than be part of it.
Quite a bit different than avoiding it (which would also be a good idea).

If you aren't part of the solution you are part of the problem. Either way you spin it, it's his blog and it's his only safe political place.

What planet do you come from?
If you look at life in general, most people are not part of any solution but that doesn't mean they are a problem or even part of a problem.
People run for political offices for a variety of reasons but with winning an election comes a responsibility to do the very best job for the people who elected you. You CHOSE to come up with solutions. Sometimes they work and sometimes they don't but having voters criticize you comes with the job.
Term (like me) is on the back 9 of life. He has no need to run for office but that doesn't mean his points do not have merit. He has lived in the City for his entire life and has watched the City change. I think that with with age comes a certain "right" to reflect on those changes and be critical if you think it is warranted.

What if the problem is the people who you expect to be the solution? I feel I serve a purpose just informing you and others. Now may I ask what part of all this have you been a party to? Are you a watcher or an avoider?

Then don't speak for another person. With age comes a certain right translates into you lose your filters as you age and feel you can say whatever you want. Right, wrong, correct, incorrect, bad information included.

Read what I wrote again. I will save you the trouble.
It was:

IOW, when you try to slant what as written, you lose credibility.

Now I realize that because you seem to think everything is fine in the City, and Term is just causing trouble, some of what I write might be above your head.
Sorry if you don't understand the difference.
