"LIVIN' ON THE EDGE" aerosmith
As I walked in to Monday's council meeting I saw some of the "regulars" sitting in the back row were Mr. and Mrs. Hal Werner. I took in at a quick glance that Hal's wife Barbara seemed quite stressed. In addition, neither of their children attended. They read their statements and left after the visitor portion.
During the visitor time, both got up and read from prepared statements regarding the situation their family is facing because of living next to Jackie's Bar. Among the allegations were observing a woman having sex in the parking lot, customers urinating on their property, loud noise, motorcycles, and cars doing "donuts" in the parking lot. Hal also mentioned a death threat against the Werner family. Now, I have no way of knowing if this is true or not, but it appears true to Hal. This situation could turn ugly very quickly under the wrong set of circumstances.
I worry that the Werner’s do not believe anyone of authority takes their issues seriously. It's past the time for attorneys, it's time the city manager and police chief sat down with both parties and aired it out before someone decides to take things into their own hands.
I have been told councilperson Lori DiNallo has even tried to negotiate a truce.
I'll be the first to tell you I have no idea if the Werner’s even have legitimate concerns but this sore seems to have festered for the past three years and the time to end it is way past due.
I don't want to be an alarmist but take my word for it I wasn't the only person uncomfortable at Mondays meeting.

I agree with you that it is time for the City administration to work out some sort of truce between the two sides in this. This "fight" is far beyond stupid.
Having said that, I suspect that it will be like the Israelis and Palestinians. Both sides want what they want and no one else could possibly have a view that is correct.
From what I have observed, the bar wants to be a good neighbor. The Werners on the other hand, simply want the bar gone. They don't appear to be able to compromise at all.
The bar next to their property has been there as long as I have been alive. There were a few years when it was closed BUT it has always been a bar.
If there have been police visits for the things that they allege, then there is a problem. However, I find most of what they claim to be very hard to believe. Only the police reports, and the follow ups, will be able to shed light on this.
"loud noise"? Does this mean the bar traffic or the trains on the other side of the bar? Both have been there since long before the Werners inherited the house.
Hal, you wasted your time as a Councilman on this issue with no success. Maybe it is time that you listen instead of speaking?

Council records are woefully behind on Painesville.com, so I can't view the meeting nor can I read the minutes. But the Werner family has complained about Jackie's since it opened. Back when he was an elected official, Hal spent more time in meetings grandstanding against this bar than he did listening to his constituents.
NOW - I don't condone the behaviors mentioned, especially death threats against anyone. That being said, Hal would have probably had better luck getting the city and Mr. Harless, the owner, to take him seriously had he not cried "wolf!" so many times (including before the bar even opened).
If the city should get themselves involved with something in my ward, I'd rather it be the crumbling streets, the perpetually-clogging sewers, etc. than mediating a simple neighbor dispute, which is all this really is.

I am not the only person uncomfortable about Hal! this could turn ugly if you let this guy keep messing with Jackies and its patrons! GEE if he keeps complaining. Maybe we can build a sound proof wall and we can pay for it! What do you think LIB!!

A homeowner should have a reasonable expectation of peace and tranquility at their residence. Our homes are a place of refuge. The city seems to calculate the benefits received by a business, against the minor tax benefit of one, or even many homeowners, in deciding,or not deciding, what action to take. The only reasonable response cannot be either/or, but both. No homeowner should be driven out by any business, and no business driven out by any homeowner. It is a matter of common decency and respect, which, given human nature, unfortunately, needs to be refereed by those in authority. Hopefully, this situation will come to a civil end, but from what I`ve seen, the homeowners may be better off moving than expecting anyone in city government coming to their aid. (Assuming their grievances are valid, and my money is on that they are valid.)
Term this has been going on since Hal was elected and he is not totally the Angel in. This .. The put up a pipe fence without permits to block part of the driveway . This is on the right od way that he is deeded to use but so. Is Jackies, and he refuses to remove it so both parties have use. When Jackies first open he complained that they were blocking his view from his driveway to the tracks. Thus is when cars park infront of the bar. That has been going on since it was Mikes and no complaints then. There is just bad blood between Warner and Jackie's and it will be that way until Jackie's closes or Warner dies. Hal wants it his way only.

First of all, I wouldn't believe one thing that came out of Hal's mouth unless I could personally verify it. If he told me the sky was blue, as they say, I would have to go take a look for myself.
Second of all, who gives a rats BEHIND what Hal is doing?

Term doesn't advertise, so hits don't translate to $$$.

TERM 12:21pm, I don't understand your Benghazi comments? Do you not feel that there should be some accountability for what happened? Do you not feel that the current administration has sidestepped accountability? Has not given us the truth? Just want to clarify.
